The Chair would hope that we could
finish all of the amendments down to the
point of the minority report, down to sec-
tion 3.17.

As far as the Chair is aware, this would
be only two or maybe three very simple
amendments, and after we got those out of
the way, the Chair would suggest that we
adjourn. This would give you, Delegate Ad-
kins, the opportunity to have your amend-
ment considered in the morning, should
you desire to do so.

Delegate Gleason, do you desire to ask
a question of the sponsor?

DELEGATE GLEASON: Yes, sir.

THE CHAIRMAN : Does Delegate Galla-
gher yield to a question?

DELEGATE GALLAGHER: Yes.
THE CHAIRMAN: Delegate Gleason.

DELEGATE GLEASON: The concern
that comes immediately to mind with this
change is with respect to eliminating or at
least narrowing the possibility for the Gen-
eral Assembly to return a primary date to
an earlier date than it is today because that
was the discussion you recall that we got
into in the Committee. If you had a total
time of 70 days, would this include the
period to override the veto?

DELEGATE GALLAGHER: Yes, it
would. In other words, the legislature in
order to protect itself would really have to
act within 49 days, because of the fact that
the governor has 20 days to hold the bill
after it has been presented to him. If he
held it the full 20 days, and vetoed, they
would want one more day to override it.
So consequently it actually means a 49-day
override period for action by the Assembly.

THE CHAIRMAN: Are there any ques-
tions of the sponsor?

Is there any discussion?
(There was no response.)
Are you ready for the question?

THE CHAIRMAN: The Clerk will ring
the quorum bell. The question arises on the
adoption of Amendment No. 11 to the Com-
mittee Recommendation LB-2.

A vote Aye is a vote in favor of Amend-
ment No. 11. A vote No is a vote against.

Cast your votes.

Have all delegates voted? Does any dele-
gate desire to change his vote? The Clerk
will record the vote.

There being 90 votes in the affirmative
and 3 in the negative, the motion is carried
and the amendment is adopted.

Delegate Gallagher, do you still desire
to hold your amendment U for the time
being?

DELEGATE GALLAGHER: Yes, sir,
just briefly.

THE CHAIRMAN: Delegate Dulany, do
you desire to offer your amendment X?

DELEGATE DULANY: Yes, please, Mr.
Chairman.

THE CHAIRMAN: The pages will please
distribute amendment X.

DELEGATE JOHNSON: Mr. Chairman.
THE CHAIRMAN: Delegate Johnson.

DELEGATE JOHNSON: Mr. Chairman,
I rise on a point of personal privilege.

THE CHAIRMAN: State the privilege.

DELEGATE JOHNSON: Mr. Chairman,
I should like to recognize the presence of
an outstanding young Marylander and a
fine athlete, a young man who has, I am
sure, more than a passing interest in this
constitution, but more particularly more
than a passing interest in a delegate to this
Convention.

I would like the Committee of the Whole
to welcome the groom-to-be, Tommy Phoe-
bus, the American League Rookie Pitcher
of the Year who is in the gallery to the
right.

THE CHAIRMAN: Delighted to have
you here.

(Applause.)

READING CLERK: Amendment No. 12
to Committee Recommendation LB-2 by
Delegate Dulany:

On page 1, section 3.02, Legislative Dis-
tricts, line 20, after the period insert the
following sentence: "To the extent prac-
ticable, no county shall be divided so as to
comprise only a part of more than one Sen-
ate district nor so as to comprise only a
part of more than one Delegate district."
