DELEGATE GALLAGHER: Mr. Chair-
man, I have asked about 45 minutes ago
for the preparation of an amendment to
section 4. 13 which will make it harmonious
with that section of the article in the legis-
lative branch that has already been passed
by the Committee of the Whole.

It is not here at the moment.

THE CHAIRMAN: Let me inquire
about it. Is the chief page here? Do you
have an amendment to section 4. 13 by
Delegate Gallagher?

We will pass it and come back to it,

DELEGATE GALLAGHER: Mr. Chair-
man, again in section 4. 17, prior to my
discussion with Chairman Morgan and con-
cerning the meaning on line 26, page 6,
subsequent to its passage, I prepared an
amendment which I should like to have
offered. I doubt if it is ready. It went out
the same time as the other.

THE CHAIRMAN: You have another
amendment to the same section, on line 18.
Do you still wish to offer that?

DELEGATE GALLAGHER: I do, sir.

THE CHAIRMAN: Let us proceed to a
consideration of that.

DELEGATE GALLAGHER: I have not
seen the amendment.

THE CHAIRMAN: The page will please
distribute Amendment AH. This will be
Amendment No. 3. The Clerk will read the
amendment.

READING CLERK: Amendment No. 3
to Committee Recommendation Number
EB-1, by Delegate Gallagher: On page 6
Section 4. 17, Return of Vetoed Bill, line
18, after the word "bills" insert the words
"or to the next regular session".

THE CHAIRMAN: Is the amendment
seconded?

(The amendment was seconded. )

THE CHAIRMAN: The amendment hav-
ing been seconded, the Chair recognizes
Delegate Gallagher to speak to the amend-
ment.

DELEGATE GALLAGHER: Mr. Chair-
man, in answer to a question of Delegate
Della to Chairman Morgan, it was stated
by Chairman Morgan that it was the in-
tention of the Committee on the Executive
Branch that if there was not a special
session to consider bills vetoed by the gov-
ernor, that it was the intention of this
section that vetoed bills could not be re-
considered for overriding at the next regu-
lar session, and I believe Chairman Morgan
indicated that this was the result of an
agreement or understanding with our joint
committee that we had set up with the
legislative and executive branches.

While I did not have an opportunity to
check that out with the representatives of
the Legislative Branch Committee, I do
feel it was always the intention of our full
committee that the vetoed bills always be
considered for overriding. Consequently I
offer this amendment, hopefully with the
ultimate concurrence of the Committee on
the Executive Branch to allow vetoed bills
to be considered either at a special session
if there be one, or at the next regular
session, so that there will never be a time
when a bill vetoed by the governor may
not be considered for overriding by the
General Assembly.
