1322 CONSTITUTIONAL CONVENTION OF MARYLAND [Nov. 28]

THE CHAIRMAN: Delegate Johnson.

DELEGATE JOHNSON: Mr. Chairman,
I have a question. I believe it probably
should be directed to Delegate Morgan,
if he will yield.

THE CHAIRMAN: Delegate Morgan,
do you yield to a question?

DELEGATE MORGAN: I yield.
THE CHAIRMAN: Delegate Johnson.

DELEGATE JOHNSON: Delegate Mor-
gan, this question may or may not, or
should or should not be directed to you, I
am not certain. But I believe I have heard
or read of a compromise pertaining to the
Board of Public Works, or some other
named board, that would consist of five
members. One would be the comptroller,
another would be the treasurer, and the
governor, of course, and two others ap-
pointed by the governor.

Could you tell me what happened to
that idea?

THE CHAIRMAN: Delegate Morgan.

DELEGATE MORGAN: That so-called
compromise was offered in the Executive
Branch Committee and was defeated. It
was also offered I believe again this morn-
ing, but it was the feeling of the majority
on the Committee that that did not repre-
sent a compromise, that it represented a
capitulation on the part of the majority,
and so by a 15 to 5 vote the Executive
Branch Committee voted to adopt the
amendment that we have before us now as
the compromise.

THE CHAIRMAN: Delegate Johnson.

DELEGATE JOHNSON: Delegate Mor-
gan, how does that compromise or capitula-
tion that we were just speaking about,
differ in principle really from the compro-
mise proposal that your Committee just
offered?

THE CHAIRMAN: Delegate Morgan.

DELEGATE MORGAN: I think the ma-
jority of the Committee felt that a five-
man Board of Public Works was too large
and too unwieldy to go over the large agen-
das that the board has, and that a three-
man board would be sufficient to do that.
Also at the time that that was proposed to
us with the compromise, the majority of the
Committee would not agree to elect a comp-
troller, and we would not agree with an
elected attorney general, or a treasurer
elected by the General Assembly. And so we
agreed to this so-called compromise instead

of its having been a capitulation on the
part of the majority. In lieu thereof the
Committee adopted the proposal which I
have offered as an amendment to Commit-
tee Recommendation No. 1.

THE CHAIRMAN: Delegate Johnson.

DELEGATE JOHNSON: Delegate Mor-
gan, would you agree that inasmuch as the
Committee has provided for the office of
comptroller in the constitution and prob-
ably the election thereof, if you can speak
for the entire Committee — I don't know
whether you can or not — but should the
comptroller not be on this board?

THE CHAIRMAN: Delegate Morgan.

DELEGATE MORGAN: The Committee
voted that down twice, and I would be op-
posed to it the third time.

THE CHAIRMAN: Delegate Johnson.

DELEGATE JOHNSON: Was that be-
fore or after the action of the Committee
of the Whole with respect to the inclusion
in the constitution of the office of comp-
troller?

THE CHAIRMAN: Delegate Morgan.

DELEGATE MORGAN: That was be-
fore the action of the Committee of the
Whole, but at the present time I would be
very much opposed to it.

THE CHAIRMAN: Delegate Johnson.

DELEGATE JOHNSON: I would just
like to see the Committee get together for
another meeting, Mr. Chairman.

THE CHAIRMAN: I do not think we
can continue these recesses to permit the
Committee on the Executive Branch to meet
indefinitely.

For what purpose does Delegate Clagett
rise?

DELEGATE CLAGETT: Mr. Chairman,
to ask Delegate Morgan to yield to a
question.

THE CHAIRMAN: Delegate Morgan,
do you yield to a question?

DELEGATE MORGAN: I yield.
THE CHAIRMAN: Delegate Clagett.

DELEGATE CLAGETT: Delegate Mor-
gan, would you please explain to me where-
in this amendment avoids the dispersion of
the executive authority and the ability of
the government to implement its programs?

THE CHAIRMAN: Delegate Morgan.
