be open since the recommendation does not
fix the name as part of the recommendation.

The Chair would not think the composi-
tion could vary from that set out in the
recommendation, namely, that it would con-
sist of three persons, the governor, the
head of the principal department desig-
nated by the governor and an individual
appointed to the board by the General As-
sembly or, if the amendment prevailed, and
the comptroller. Does that answer your
inquiry?

DELEGATE WEIDEMEYER: That an-
swers the inquiry, and I would like to have
a little time to get an amendment to that
amendment.

THE CHAIRMAN: I think we had bet-
ter debate the amendment first. We have
not started to do that.

The Chair recognizes Delegate Fornos to
speak to the amendment. The amendment
that is now before you is an amendment to
Amendment No. 4. It will be designated
as Amendment No. 5. It will strike from
line 17 of Amendment No. 4 the words "an
individual" and all of line 18, and substi-
tute the words "the comptroller."

Delegate Fornos.

DELEGATE FORNOS: Mr. Chairman,
I think the discussion centering around the
need for the retention or the elimination of
the comptroller was made this morning,
and I stand on the arguments that were
made this morning to support my amend-
ment.

THE CHAIRMAN: Delegate Morgan.

DELEGATE MORGAN: Mr. Chairman,
I rise in opposition to the amendment as
proposed by Mr. Fornos.

The proposal which I have offered as an
amendment was adopted as a result of a
compromise, and I am hoping that no
amendments will be adopted to it.

THE CHAIRMAN: Delegate Boyce.

DELEGATE BOYCE: May I ask Mr.
Fornos a question, please, sir? I am con-
fused.

THE CHAIRMAN: Delegate Fornos, do
you yield to a question?

DELEGATE FORNOS: Yes, sir.
THE CHAIRMAN: Delegate Boyce.

DELEGATE BOYCE: With your sub-
stitution, Delegate Fornos, would this mean
then that at a later date if this Convention

saw fit to make the comptroller an ap-
pointive officer, the governor would then
have two appointments to this Board, and
himself?

THE CHAIRMAN: Delegate Fornos.

DELEGATE FORNOS: I think that
would be something we would have to con-
sider when we reached that point.

DELEGATE BOYCE: I do not think
that is true. I am assuming, and probably
assuming wrong, that the comptroller
should be an appointive officer. Then this
would really basically mean the governor
would be on this board with two of his
appointees, is that not correct? That is my
question.

THE CHAIRMAN: Delegate Fornos.

DELEGATE FORNOS: I think if you
have that fear that I would be amenable
to including in the language of my amend-
ment that the governor shall have no more
than himself and one other appointment.

THE CHAIRMAN: Do you have any
further question, Delegate Boyce?

DELEGATE BOYCE: I think you would
not get my vote unless you did that, sir.

DELEGATE DORSE Y: Mr. President.
THE CHAIRMAN: Delegate Dorsey.

DELEGATE DORSEY: I would like to
ask Delegate Fornos if he would change the
language of his amendment to read, "the
comptroller, elected by the people"?

THE CHAIRMAN: Delegate Fornos.

DELEGATE FORNOS: Yes, sir. Thank
you very much.

THE CHAIRMAN: Delegate Dorsey.

DELEGATE DORSEY: I would be glad
to second it.

THE CHAIRMAN: Are you changing
your amendment?

DELEGATE FORNOS: That is amen-
able to me, Mr. Chairman.

THE CHAIRMAN: That is not the ques-
tion. Are you changing it?

DELEGATE FORNOS: Yes, sir.

THE CHAIRMAN: Are you changing
your written amendment?

DELEGATE FORNOS: I will have to
do so, unless there are any other questions.
If I may be excused to do so, I will.
