DELEGATE SCANLAN: I am sorry.
The motion is to delete the last line on page
4, and substitute for it language reading
"That is determined in whole or in part
with reference to the result accomplished."
As I understand it, it would not be neces-
sary just to have a contingent fee to defeat
something or get something approved. If it
in any way was contingent upon the degree
of your success at the Convention, in shad-
ing a point of view, for example, it would
then be covered by the prohibition against
contingent fees.
THE PRESIDENT: Delegate Bam-
berger?
DELEGATE BAMBERGER: That same
amendment would have to be made after
the word compensation, on the seventh line
of paragraph 7.
DELEGATE SCANLAN: Delegate Bam-
berger is quite correct, and I would make
the same change there to encompass both
in the same committee motion.
THE PRESIDENT: Delegate Bamberger,
the Chair is in doubt. You are. speaking of
the seventh line of paragraph 7?
DELEGATE BAMBERGER: Yes.
THE PRESIDENT: And following the
last word in the line, compensation?
DELEGATE BAMBERGER: Yes.
THE PRESIDENT: And would you de-
lete anything in the next line then?
DELEGATE BAMBERGER: I would de-
lete all of the next line. Just a minute. I
would delete all of the next line and delete
the words matter of proposal on the ninth
line.
THE PRESIDENT: The tenth line. I
am sorry. You are right. As I understand
it, then, the proposal by the committee is
to amend section 7 on page 4 by adding,
after the last word, "compensation," in the
seventh line, the phrase, "that is determined
in whole or in part with reference to the
result accomplished," and deleting all of the
eighth line, and first three words, "matter
or proposal" in the ninth line, and further,
by deleting the last six words, being all of
the last line, and inserting in lieu thereof,
the words, "that is determined in whole or
in part with reference to the result ac-
complished."
Is that the suggestion of the Committee
Chairman?
DELEGATE SCANLAN: That is.
THE PRESIDENT: Is there any objec-
tion to the change suggested by the
committee?
If not, then the proposed regulation will
be considered as having been so amended.
You had another suggestion.
DELEGATE SCANLAN: No. At this
point, Mr. President, I am ready to move
that the proposed regulation favorably re-
ported on in this second report of the
Committee on Rules, Credentials and Con-
vention Budget, be adopted by the Conven-
tion.
THE PRESIDENT: Is there a second?
(The motion was duly seconded,)
THE PRESIDENT: Is there any dis-
cussion?
DELEGATE DUKES: David Dukes,
Prince Georges County. Mr. President, I
have known Chairman Scanlan for a num-
ber of years and have never been unim-
pressed by his eloquence and ability. Even
today his staying power is fine. Because of
my impression of him, I studied very care-
fully the report of the Committee on Rules,
and I listened to each and every word. I
cannot see where we gain anything by the
proposed regulations except perhaps a par-
tial list of various witnesses who will ap-
pear before the Convention. Beyond that it
seems to me that inasmuch as we have no
sanctions, inasmuch as we apparently have
not seen fit to do that which we could have
done, and that is provide some sort of
censure or other punitive measures for
those of us who should choose not to worry
about the regulations ourselves, not report
improper comments made to us or improper
attempts to approach the Convention, inas-
much as I can see not where we gain any-
thing other than, as I said, a list of wit-
nesses, which can easily be obtained by
asking desirable questions of the witnesses
when they appear before the committees or
the Convention, and inasmuch as my dear
old daddy told me, if it does not do some
good, it probably does some harm, I am
against the motion.
THE PRESIDENT: Is there any further
discussion?
(There was no response.)
THE PRESIDENT: Are you ready for
the question?
(Call for the question.)
