The question arises on the adoption of
Amendment No. 39 to Committee Recom-
mendation JB-1 to amend section 5.20, by
adding at the end, after the period in line
24, a new sentence, reading: "A member
of a commission shall receive no compensa-
tion for his services."
A vote Aye is a vote in favor of Amend-
ment No. 39. A vote No is a vote against.

DELEGATE DELLA: I do not see any-
thing in our proposal, who shall call the
nominating commission together. Is it by
the action of the governor?
THE CHAIRMAN: Delegate Mudd.
DELEGATE MUDD: As I recollect,
Delegate Della, without reviewing these
sections, and frankly, it would be within
the rule of the legislature to detail those
requirements, I assume. I think there is a
provision or there was a provision for the
chairman — what section is that?
THE CHAIRMAN: I assume that Dele-
gate Della refers to section 5.20, Delegate

Mudd. His question, as I understand it, is
that that section contains no provision for
the first meeting of the commission.
DELEGATE MUDD: I agree that it is
not mandated in the language of our com-
mittee recommendation, but certainly it is
implicit that the commission must assem-
ble because it is said in the second sen-
tence, each commission shall elect one of its
members as chairman, and from there on,
I would say the responsibility would be the
chairman's.
THE CHAIRMAN: Delegate Della.
DELEGATE DELLA: Who would call
the nominating commission together in the
first instance?
THE CHAIRMAN: Delegate Mudd.
DELEGATE MUDD: I would assume
it would be called together by notice from
someone when there is a vacancy to be
filled, if they had not previously elected a
chairman, that would be the first order of
business.

DELEGATE MUDD: No, frankly, we
had not.

in the next amendment that has come out
of the Legislative Branch Committee,
there is a provision there providing that
the General Assembly shall enact a conflict
of interest statute for all elected officials
of the state.
Is there anything within this recommen-
dation of the Committee or within your at-
tention that conflicts of interest would
cover these commissions?
