know, you can affect a search without a warrant.-
What I am referring to is where the State acts
as an individual in a civil proceeding, and would you bar
the State in obtaining the evidence because of this amend-
ment, whereas the "rivate citizen could obtain the same
information and it could be admissible in a civil case?
DELEGATE BOTHE: I think the point of the amend-
ment is exactly the opposite to what you state, and that
is to make it impossible for a private citizen to do that
which the State couldn't do.
