there was no grant in Article 11 (a) for a charter gov-
ernment, but Baltimore County and Anne Arundel and I
I assume Montgomery County adopted it in their charter and
there has always been a doubt as to whether or not this
was correct.
DELEGATE MOSER: I see your point. The answer
categorically is that it is clear that a county may adopt
in its charter a referendum procedure. It is absolutely
clear they can. I think it is also clear thatthe legislature
could pass a law requiring all counties to have a referen-
dum procedure. If it affected all counties, it could
require the same nrocedure in all counties too.

DELEGATE WEIDEMEYER: With such a provision
is it possible they could likewise withhold the right of
referendum to the newly formed counties whereas,under
expressed provisions of your recommendation, they might
not be able to do it as the counties and municipalities
alreadv in existence?
