This is a tremendous power, and a power that is

protected always from abuse by the fact that it may be

4

withdrawn by the General Assembly.

Now, this power, which has never been statutorily

6

granted to the community colleges or the State colleges,

7

indeed never even requested by either one of those col-

8

leges, is constitutionally given to both of these branches

9

of the tri-party system of higher education by the Majority

10

Report.

Now, turning to page 30 of this booklet entitled

The Efficiency of Freedom, there are two points, and I

13

think these points should be borne in mind by everyone.

14

First of all, this report does not advocate constitutional

15

autonomy for higher education. It advocates legal autonomy,

16

and it specifically says that the Committee recommends

17

either a constitutional amendment or a statute that would

18

include the following provisions.

Now, we of the Minority cannot understand why

20

in their memorandum and in their presentation today this

21
