the minority in their proposed Section 804 do refer to

governing boards of higher learning and later in the sec-

tion mention such types of acts which these boards
|

can provide.

Again, the executive article which is given ten-

tative approval by the majority of the people here today
|
|

in its report made the specific provision for a board in
|
|

|
the educational area. It apparently had anticipated some
|
|

|
action in this field by the committee referring to
|
|

|
education .

We contend that after 97 years in being, the
|
|

|
naming of the State Board of Education and its superin-
|
|
14
|
tendent selected by that board is complementary in
|
|
15
|
nature with those sections providing for such exceptions
|
|

|
in the executive article. Certainly it is restrictive
|
|

|
only in the event that one is not committed to the lay
|
|
18
|
board concept for the governing of educational institu-
|
|
19
|
tions. It may well be desirable at this point to discuss
|
|
20
|
what the concern is about for a lay board of education.
