committees whose only function it is to make recommendations

to the parent organization. Proceedings is really a term

3

of art which refers to the court, and it only refers to

4

the formal proceedings, that is, the proceedings in court;

5

it does not go to the deliberative process of the court.

Essentially it is almost a term of limitation. But the

7

intent is to provide this area of public information and to

8

broaden it, but because there is some concern about

9

deliberations of the court, this word "proceedings" refers

10

to the formal aspects of it, not to the deliberative

11

process.

"Meetings" has been interpreted and, despite

13

very broad statutory language, the courts have been quite

14

restrictive. A meeting was defined to include only

15

gatherings where members sit as a joint body at an

16

authorized meeting duly assembled. This is based on a

17

California case, Adler versus the City Council.

18

Again, I would hope that the court in construing

19

this provision, if they would construe it as broadly as

20

possible, but I must admit that the courts with the history

21

of secrecy have generally taken a very restrictive view of
