1799.  NOVEMBER.               LAWS OF MARYLAND.

                                        CHAP. XLI.
An ACT for the relief of Thomas Hewitt, of Prince-George's coun-
   ty.      Lib. JG. No. 3. fol. 281.

WHEREAS it is represented to this general assembly, by the petition of Thomas Hewitt, of
Prince-George's county, that by a variety of misfortunes in trade he is rendered unable
wholly to satisfy his debts, and that he is at this time in actual confinement, having been committed
at May term last in the general court on a capias ad satisfaciendum:  And whereas the said Thomas
Hewitt has prayed a special act may pass in his favour; therefore,

II. BE IT ENACTED, by the General Assembly of Maryland, That the chancellor shall be and he is
hereby authorised, on application by the said Thomas Hewitt, by petition in writing, to be released
from his debts, to extend to the said Thomas Hewitt all the provisions of the act of assembly of last
session, entitled, An act for the relief of sundry insolvent debtors, so far as the said provisions ex-
tend to traders, on the said Thomas Hewitt satisfying the chancellor that he has fully complied with
the conditions required of traders by the aforesaid act.

                                          CHAP. XLII.
An ACT to prevent the going at large of swine in the town of
    Lower-Marlborough, in Calvert county.    Lib. JG. No. 3. fol. 281.

BE IT ENACTED, by the General Assembly of Maryland, That from and after the first day of March,
eighteen hundred, no swine belonging to the inhabitants of said town shall be suffered to go at
large in the town of Lower-Marlborough, in Calvert county; and if any person shall find any such
swine going at large in the town of Lower-Marlborough aforesaid, it shall and may be lawful for such
person to kill, or cause to be killed, such swine.

II. AND BE IT ENACTED, That if any person shall be sued for killing any such swine going at
large in the town of Lower-Marlborough aforesaid, such person may plead the general issue, and give
this act and the special matter in evidence.

                                          CHAP. XLIII.
An ACT for laying out two roads to Exeter mills, in Caroline coun-
  ty.  Lib. JG. No. 3. fol. 282.

WHEREAS it is represented to this general assembly, by the petition of Solomon Bartlett and
others, of Caroline county, that they labour under great inconvenience for the want of pub-
lic roads to said mills,

II. BE IT ENACTED, by the General Assembly of Maryland, That it shall and may be lawful for Moses
Leverton, Cain Ross, Levin Nabb, James Wright, of Roger, and Abraham Ross, or any three or
more of them, to survey and lay out two roads from said mills, in the following manner; that is to
say, one road leading from said mills, by Thomas Watkins's plantation, until it intersects the main 
road in or near the plantation of Nathan Wright, and one other road from said mills, down the
north-east side of the north-west branch of Nanticoke river, until it intersects the main road in or
near the villag eof Federalsburgh; provided, the said roads shall not pass through the house, yard,
garden, orchard or meadow, of any person or persons.

III. AND BE IT ENACTED, That it shall and may be lawful for any justice of the peace for the
county aforesaid, on the complaint, on oath or affirmation, of any person or persons through whose
lands the said roads may pass, to issue his warrant to the sheriff of the county, to summon a jury, to
be and appear on the premises of the complainant or complainants, to ascertain, on oath, the damage
such person or persons may have sustained by such roads; and the damage, when so ascertained, shall
be paid by the persons praying the said roads, together with all cost and charges arising on the same.

IV. AND BE IT ENACTED, That the said roads shall be surveyed, laid off, cleared, and rendered
fit for travelling, twenty feet wide at the least, at the proper costs and expence of the said petition-
ers; and when the same shall be viewed, examined and received, by two of the neighbouring justices
of the peace, the said justices shall certify the said roads to the levy court of Caroline county, and
thereafter the said roads shall be recorded and deemed two of the public highways of the said  coun-
ty, and be overseen and repaired as other public roads thereof.
