36            VOTES and PROCEEDINGS, November, 1799.

    The following message was prepared, read, agreed to, and, with the bill therein mentioned,
and the four bills and three resolutions next before mentioned, sent to the house of delegates by
the clerk.

By the SENATE, December 31, 1799.
        GENTLEMEN,
    THE senate were of opinion that the bill respecting a partition of the estate of John Davidson,
deceased, involved in it principles of serious importance in legislation; it occupied their
reflections for a considerable time, and the deliberation which they gave it induced them, in a
full senate, to reject it.  Several of the gentlemen who passed upon that bill are now absent; we
therefore think it would be improper to reconsider it, particularly at this advanced period of the
session.

    On motion, ORDERED, That Mr. Dennis and Mr. Hemsley be added to the committee for the
examination of engrossed bills.
    the clerk of the house of delegates delivers to the clerk of the senate a bill, entitled, An act 
to authorise a sale of the real estate of the late John Rogers, if approved of by the chancellor;
thus endorsed; " By the house of delegates, December 13, 1799:  Read the first time and ordered
" to lie on the table.
                                                        " By order,                                W.  HARWOOD, clk.
" By the house of delegates, December 31, 1799:  Read the second time and will pass.
                                                        " By order,                                W.  HARWOOD, clk."
A bill, entitled, An act to lay out, alter and confirm, certain roads in Allegany county, and a
bill, entitled, A supplement to an act to regulate elections, severally thus endorsed; " By the
" house of delegates, December 31, 1799:  Read the first time and ordered to lie on the 
" table.
                                                        " By order,                                W.  HARWOOD, clk.
" By the house of delegates, December 31, 1799:  Read the second time by especial order and
" will pass.
                                                        " By order,                                W.  HARWOOD, clk."
The following resolutions:
By the HOUSE of DELEGATES, December 31, 1799.
    RESOLVED, That the treasurer of the western shore pay to Richard J. Orme, or order, the 
sum of thirty-five pounds thirteen shillings and nine-pence current money, being the amount of
the sum paid by him to person having claims against a certain Alice Smith, whose land the
said Orme escheated, and which he has obtained a patent for.

By the HOUSE of DELEGATES, December 31, 1799.
    RESOLVED, That the treasurer of the western shore pay to Darby McNamara, a poor and disabled
soldier of the first Maryland regiment, the sum of twenty-five pounds six shillings and
eleven-pence, with interest from the first of August, one thousand seven hundred and eighty, in
consideration of a depreciation certificate for that amount heretofore issued to him and since
lost.
                                                        By order,                                  W.  HARWOOD, clk.
By the HOUSE of DELEGATES, December 31, 1799.
    RESOLVED, That the auditor be and he is hereby authorised and directed to liquidate, ascertain
and adjust, the amount of certificates and money that have been paid by Elizabeth Atkinson,
deceased, for the real estate of Isaac Atkinson, purchased by her under the impression that it
was subject to confiscation, but which the chancellor has since determined was not liable to be
confiscated, and that the treasurer be and he is hereby authorised and directed to pay the amount
thereof, with interest from the time of payment into the treasury, to the representatives of the
said Elizabeth Atkinson, deceased, or their order.

And also the following message:
By the HOUSE of DELEGATES, December 31, 1799.
        GENTLEMEN OF THE SENATE,
    WE cannot at present determine the precise period when the session can be closed, but feel
confident that it cannot be terminated by so early a day as Thursday next.  We are endeavouring
to complete the business before us, and hope we shall be able to conclude the session by Saturday
next.  The determination of the senate to act upon no private business after Wednesday is communicated
to us at so late a period that we fear injustice might be done to individuals if rigidly
adhered to.  We shall send no business of that description to your house unless we think it may
at this session require the interposition of the legislature.  We flatter ourselves that a sense of
public duty will enforce the attendance of the members of the senate until the session can with
propriety be closed.

    Which said bills, resolutions and message, were severally read, and the bills and resolutions
ordered to lie on the table.
    The clerk of the house of delegates returns the bill, entitled, A supplement to the act, entitled,
An act to erect a town in Talbot county, thus endorsed; " By the house of delegates,
" December 27, 1799:  Read the first time and ordered to lie on the table.
                                                        " By order,                                W.  HARWOOD, clk.
