County faithfully to perform the duties of the same; and he
shall also execute a bond to the State of Maryland in the'
penalty of fifty thousand dollars for the faithful performance
of his duties as Treasurer and as Clerk to the County Com-
missioners of Talbot County, and further conditioned that he
shall well and truly account for and be liable for any and all
money coming into his possession as Treasurer, or for which
he shall be answerable by law; which bond shall be secured
by a fidelity or security company qualified to act as surety or
guarantor under the laws of the State of Maryland, and shall
be approved by the judges of the Circuit Court for Talbot
County, or a majority of them, and thereafter be recorded
in the office of the Clerk of the Circuit Court for said county.

Failure of
Treasurer to
qualify.

SEC. 5. And be it enacted, That upon the failure of any
Treasurer-elect to execute the bond required and provided for
by the preceding section on or before the day upon which he
is to take possession of the office of Treasurer and enter upon
the duties thereof, in conformity with the provisions of this
Act, the County Commissioners of Talbot County shall ap-
point some qualified voter of Talbot County as Treasurer in
the place of the one who failed to qualify, and so on after
every interval of thirty days until a Treasurer shall be duly
qualified.

In case of
death, etc.
Governor
shall appoint.

SEC. 6. And be it enacted, That in case of the death, resigna-
tion or removal of the Treasurer during his term of office the
Governor of the State of Maryland shall, within twenty days
thereafter, appoint a Treasurer for the unexpired term thus
created, who shall take the oath, give the bond and perform
all the duties of said office prescribed by law, but such suc-
cessor shall not take charge of or collect any of the taxes that
were in the hands of the late Treasurer and uncollected, the
bond of the former Treasurer shall remain responsible for said
taxes, and they shall be collected and accounted for under the
laws governing such cases.

Additional
duties of
Treasurer.

SEC. 7. And be it enacted, That the County Treasurer, in
addition to his duties as Treasurer, shall perform all the duties
of Clerk to the County Commissioners of Talbot County,
without any extra compensation whatsoever; and he is em-
powered to administer an oath or affirmation to any account
to any person presenting a claim against Talbot County, but
he shall not administer such oath or affirmation in any other
place than in his office or that of the County Commissioners,
nor shall he be allowed any fee for administering said oath or
affirmation. \
