Report to
Mayor.

SEC. 8. And be it enacted, That during the month of May
of each and every year the Board of Street Commissioners
shall make a detailed report to the Mayor and Council of
Hagerstown of their operations of the lighting plant in their
charge, and at the same time shall furnish an estimate to the
Mayor and Council of the probable expense of conducting

said plant for the ensuing year; and the Mayor and Council
fshall have power at any time to appoint a visitor who shall
have the privilege of examining the books of the Board of
Street Commissioners and the plant operated by them, and
shall report the result of his investigation to the Mayor
and Council.

for operating

SEC. 9. And be it enacted, That to provide the sum of money
necessary to pay the cost and expenses of conducting and
operating said plant, and fulfilling and complying with the
provisions of this Act, the Mayor and Council of Hagerstown
are hereby authorized and required annually to levy on the
assessable property of the town ten cents on every one hun-
dred dollars' worth of assessable property, and the sum of
money collected upon said levy shall constitute part of a

Lighting Fund

Separate fund to be known as the lighting fund, and to be kept
by the tax Collector and to be applied to the payment of said
cost and expenses, and to and for no other use and purpose.
Said fund to be placed and drawn out as directed by Section
one hundred and sixty -seven of Article 22 of the Code of Public
Local Laws of Maryland, title "Washington County," sub-
title "Hagerstown," and in case the said levy should not be
sufficient to pay the said costs and expenses, the Mayor and
Council aforesaid is hereby authorized and required to levy
and appropriate of the thirty cents of tax authorized by Sec-
tion one hundred and ninety-five of said Article 22 of the
Code of Public Local Laws of Maryland, and not otherwise
specifically appropriated by said section, as much thereof as
may be necessary for the purpose of raising the amount set
forth in the estimate provided in Section eight of this Act,
and the said sum of money so collected from said tax as
aforesaid, appropriated or levied with the sums received from
pro rata apportionment of the same, as provided by Section
one hundred and sixty-six of said Article 22 of the Code of
Public Local Laws of Maryland shall constitute a separate
fund known as a lighting fund, to be kept, applied and drawn
in the same manner and form as the same collected from said
taxes of ten cents ; provided that the Mayor and Council of
Hagerstown shall not be compelled under the provisions of
this section to levy more than necessary to pay the amount
set forth in the estimate provided in Section eight of this Act.
