Authority to
lease lands,
erect buildings
equipment, etc

SEC. 4. And be it enacted, That the Board of Street Com-
missioners are hereby authorized and empowered, for the pur-
pose of this Act, to purchase or lease land either improved or
unimproved within the limits of Washington County, Mary-
land, in the name of the Mayor and Council of Hagerstown,
and to erect, change or alter such buildings thereon as may
be necessary or advisable in the opinion of the said Board of
Street Commissioners, and to purchase and contract for all
other things necessary to complete the plant and equipment
authorized by this Act, which said plant and equipment when
purchased, shall be the property of the Mayor and Council of
Hagerstown; subject, however, to the power of the Board of
Street Commissioners to sell or exchange any part of said
plant and equipment other than the buildings, when the same
shall be worn out, inefficient or unserviceable, or it shall be
deemed advisable by the said Board of Street Commissioners
to replace the same with a better article; and to provide for
the payment of the buildings, plan and equipment authorized
by this Act, the proceeds arising from the bonds provided
for in the preceding section of this Act shall constitute a
separate fund to be kept by the Collector of Taxes, and to be
applied to the payment of such buildings, plant and equipment
and to and for no other use and purpose. Said fund to be
placed and drawn out by said Board of Street Commissioners
in manner provided for accounts for street purposes in Section
one hundred and sixty-seven of Article 22 of the Code of.
Public Local Laws of Maryland.

SEC. 5. And be it enacted, That the said Board of Street
Commissioners shall furnish arid supply to the citizens of
Hagerstown electric light service of a character usually fur-
nished to consumers, and collect at stated intervals not longer
than one month the amount charged therefor as compensation
for the service of such light; said Board of Street Commis-
sioners shall make a schedule of rates for which said light
shall be furnished to the citizens of Hagerstown; said rates to
be reasonable in amount and not lower than such as would
suggest themselves to a prudent business man having refer-
ence to the profitable operation of the plant, and said Board
of Street Commissioners are hereby authorized from time to
time to make such reasonable rules and regulations as they
may deem proper in regard to the furnishing, supplying or
discontinuing any electric light service to the consumers
thereof, or the use thereof by such consumers, including all
connections made with the buildings of consumers, and no
service of electric light shall continue to be furnished to any
