SECTION 1. Be it enacted by the General Assembly of Mary-
land, That a new section be and the same is hereby added to
Article 17 of the Code of Public Local Laws, title "Prince
George's County," sub-title "Birds and Game," to follow Sec-
tion thirty-five, to be known as Section 35A, and to read as-
follows :

hunt upon
lands of
another with-
out consent.

35A. It shall be unlawful for any person to hunt upon the
lands of another in Prince George's County, with or without
gun or dogs, except by written consent of the owner, and any
person so offending; shall be deemed guilty of a misdemeanor,
and, upon conviction, shall be fined not less than ten dollars,
for each and every offense.
SEC. 2. That this Act shall be in force from the day of its
passage.

CHAPTER 439.
AN ACT to prohibit the taking and catching of oysters for
sale in certain waters of Calvert County.

Exceptions.

SECTION 1. Be it enacted by the General Assembly of Mary-
land, That it shall not be lawful for any person to take or
catch oysters for sale with rakes, tongs or any other instru-
ment whatever in the waters of Mill Creek, Back Creek or St.
John's Creek, in Calvert County, for the period of three years
from the passage of this Act, except from lands in said waters
located and appropriated, or which may hereafter be located
and appropriated, by virtue of any Act or Acts of the General
Assembly of Maryland, authorizing the location and appro-
priation thereof for the purpose of protecting, depositing,
bedding or sowing oysters.

Penalty
for violation.
|
SEC. 2. And be it enacted, That any person violating the
provisions of the preceding section shall be judged guilty of a
misdemeanor before any justice ol the peace in Calvert County
or the Circuit Court in and for said county, and, upon con-
viction, shall pay a fine of not less than twenty dollars nor
more than fifty dollars for each and every offense, and shall
stand committed to the county jail until fine and cost are
fully paid; one-half of all fines under this Act to be paid to
the informer and one-half to be paid to the School Commis-
sioners of Calvert County for the benefit of the public schools
therein.
