previous to such election, therein naming the time and place
of holding such election, and naming three judges thereof,
who, or any two of whom, may hold such election.

In case of a tie,
death, resigna-
tion, etc.,
new election
shall be held.

Sec. G. If at any election there shall be a tie between two
persons voted for for the said offices, or if any person elected
as a member of Council die, resign, remove from the town, be
disqualified, or refuse to act, a new election shall be held in
two weeks after such fact shall have become known, after at
least one week's notice given by the Mayor, or one or more
of the Council, or five or more of the voters as directed in the
preceding section, and such election shall be held by three
judges, or any two of them, appointed by the Mayor, or one
or more of the Council, or five or more of the qualified voters,
as the case may be; and the person elected shall serve until
a new election; and if a vacancy shall occur in the office of
Mayor, from any cause, the chairman of the Council shall act
as Mayor for the unexpired term.

Sec. H. All officers of the said town, except the Mayor,
before they enter upon the duties of their respective offices
shall qualify by taking an oath before the Mayor of said town
that they will act faithfully, without favor, partiality or pre-
judice, in all things appertaining to their respective offices;
the Mayor shall qualify by taking this oath before a justice of
the peace of said Carroll County or a notary public, and a
failure to qualify within two weeks after his election shall be
deemed a refusal on the part of the person so failing to qualify
to accept the office to which he has been elected.

Sec. I. The Council shall be judges of the qualification of
the Mayor and of their own members.

Sec. J. That the five members of the Council at their
first meeting after their election shall elect one of their mem-
bers chairman of the Council, who shall be Mayor pro tem in
the absence of the Mayor, and three members of the Council
shall constitute a quorum for the transaction of business, and
the Council shall pass rules and by-laws for their own rule
and government while in session.

Time of
meeting.

Sec. K. The Mayor and Council shall meet on the first
Monday of each month at such place and hour as shall be
fixed by the Mayor or ordinance, and at such other times as
they shall adjourn to.

Sec. L. Neglect or non-use shall not work a forfeiture
of any of the provisions of this Act.
