accompanied by a duly certified check for not less than ten
per centum of the amount of the proposal, to be returned if
the proposal be not accepted, and to be held if the proposal
be accepted, together with the bond hereinafter provided for,
as security for the performance of the proposal. The Com-
missioners may reject any and all bids, or accept the proposal
of any responsible bidder at their discretion; but they shall
require any accepted bidder to enter into a contract in writing
with them, and to give bond, with security, to be approved

by them, in double the sum of said contract price conditioned
for the faithful performance of the contract; and they shall
not pay, or cause to be paid, in advance for any work not
actually done; and they shall not pay for any work done unless
it (the work) shall have been done, and the supplies and
material furnished strictly in accordance with the plans and
specifications signed and accepted by the contractor, and be
first approved in writing by the engineer and accepted in
writing by the Commissioners. Furthermore, the Commis-
sioners shall withhold for one year from the date the water
works are accepted by them, payment of five per centum of
their cost, in order to insure the establishment of the water
works in accordance with the plans and specifications of the
engineer and the contract of the contractor to save the town
harmless from any loss or failure or omission of the contractor
to fulfill in good faith his contract.

SEC. 8. And be it enacted, That at the election to be held in
the Town of Hyattsville, in Prince George's County, Mary-
land, on the first Monday in May, in the year 1900, for Com-
missioners for said town, that the question whether or not
said town shall issue coupon bonds to the amount of not more
than thirty thousand dollars, as hereinbefore set forth, shall
be and is hereby directed to be submitted to the legal and
qualified voters of said town, and it shall be the duty of the
Commissioners of Hyattsville to give public notice of the
intent of this Act in such manner and at such time previous
to the election as they may decide fit.

Manner of
election.

SEC. 9. And be it enacted, That the election provided for in
Section eight hereof shall be held in the same manner and under
the same law, rules and regulations as an election for Com-
missioners for said town of Hyattsville, and the ballots shall
have printed on them the words, "For the Issue of Water
Bonds" if the ballot to be cast for the issue, and "Against
the Issue of Water Bonds" if the ballot to be cast against
the issue. The returns of said election shall be made in the
same manner as is provided for the election of the Commis-
