And the Commissioners shall be empowered to adopt in writ-
ing such orders for the payment of moneys due and payable
to the contractors for the construction and establishment of
the water works, not in conflict with the provisions of this
Act, as shall from time to time be earned by said contractor
in prosecution of the work, the payment of property purchased
or condemned, and for material and labor furnished in pur-
suance of the provisions of this Act. The Commissioners shall
employ a competent water works engineer to prepare the

plans and specifications for the said water-works and to
superintend and to pass upon in his person the kind, quality
and character of all material and labor used in the construc-
tion arid maintenance of said water- works, and compensate him
therefor in such sum of money, to be paid in such portions
and at such times as they shall order, first to be agreed upon
in writing by and between him and them; provided, such
compensation or portions thereof so agreed upon or otherwise
paid to him shall not exceed in the total five per centum of
the actual costs of the said water works. The plans and
specifications shall be the property of the town of Hyattsville,
and be filed in the office of the Commissioners, and be open
to inspection and examination by any person interested under

sealed proposals for the construction and establishment of
such water works by advertisement in some newspaper for a
reasonable length of time, provided such advertisement
appears in three successive issues of the Engineering News, a
publication published in the City of New York, State of New
York, for at least two weeks before any proposal or proposals
shall be opened and considered. The proposals shall be in
sealed envelopes, addressed to the President of the Commis-
sioners of Hyattsville, of Prince George's County, Maryland,
and bear on its face the inscription, "Proposals for Construc-
tion of Water Works." The proposals shall be opened in the
office of the Commissioners by the Clerk of the Town Com-
missioners in their presence and such other persons, if any,
who choose to be present, on the day and at the hour named
in the advertisement for the proposals. Said proposals shall
set forth the amount of money for which the parties proposing
will construct and establish such water works, and any speci-
fied sort or portion thereof, according to the plans and specifica-
tions prepared by the engineer aforesaid, or according to any
plan or specification the proposer may submit, and the time
when such water works will be completed and ready for use, or
supplies and material furnished. The said proposals shall be
