CHAPTER 209.
AN ACT to authorize and direct the Comptroller of the
State Treasury and the Comptroller of Baltimore City,
respectively, to refund to August C. Schmidt money erro-
neously paid into the treasuries, respectively, of said State
and municipality, for licenses.
WHEREAS, In the year 1890 the Liquor License Commis-
sioners of Baltimore City received from August C. Schmidt
the sum of one thousand dollars for liquor licenses, and in the
years 1890-1891, and for licenses under a misconstruction of
the law; and
WHEREAS, The amount due by said party was only one-
half of the amount so paid by him, as was decided by the
Court of Appeals of Maryland in the case of "The State of
Maryland vs. Steifel;" the said decision being reported in
the Maryland Reports, Volume 74; and
WHEREAS, The State received one-fourth of said money so
erroneously paid, and the City of Baltimore three-fourths
thereof, and the same should be refunded by said municipality
in that proportion; therefore;
Be it enacted by the General Assembly of Maryland, That the
Comptroller of the State Treasury be and he is hereby author-
ized and directed to draw his warrant on the Treasurer for the
sum of one hundred and twenty-three dollars and seventy-five
cents, and the treasurer is directed to pay the same out of
any moneys in the treasury not otherwise appropriated.
