25. The Commissioners of the said town shall appoint
three judges of the biennial election, who shall appoint a,
clerk. The polls shall be opened at nine o'clock A.M. and
closed at three o'clock P.M. The ballots shall be carefully
counted, and a report filed with the Commissioners of said
town, and certificates of election granted by judges to the
Commissioners so elected. The judges of election shall,
before proceeding to hold an election, take oath before some
justice of the peace of Wicomico County to allow all persons
who are qualified to vote, and that they will have said ejec-
tion conducted fairly, and that no one will be allowed to vote
unless duly qualified.

How elections
shall be held.

26. If any person elected as Commissioner shall refuse to
serve as such, or his place become vacant by death, resigna-
tion, disqualification or otherwise, the remaining Commis-
sioners may fill his place from among the qualified voters of
the town. Each Commissioner before he acts as such shall
make oath before some justice of the peace that he will dili-
gently and faithfully, and to the best of his skill, perform his
duties as Commissioner without favor, partiality or prejudice,

and the justice of the peace shall make out a certificate of
such qualification, and shall file the same with the Commis-
sioners, and be recorded among the records of the town, and
the Commissioners shall meet the second Monday after their
election, and shall hold stated meetings the second Monday
in every month thereafter, and adjourned or called meetings
can be called at any time by the president of the board as
may be necessary for transaction of business, and a majority
of the Commissioners shall constitute a quorum.

27. At their regular meeting after the biennial election,
and the qualification of the newly-elected members, or as soon
thereafter as practicable, they shall elect one of their members
president, and one of their members as clerk, and one of their
members treasurer, and at their second regular meeting shall
elect a bailiff for said town, who shall not be one of the Com-
missioners, and they may elect and appoint a counsel, and
give him such compensation as may be agreed upon; one and
the same person may act as clerk and treasurer, and the bailiff
may be collector of taxes; either of the above-named officers
shall be subject to removal by a vote of the majority of the
whole number of Commissioners, and the Commissioners shall
prescribe their duties and fix their compensation by ordinance
when not otherwise prescribed by this Act.
