levying and assessing the same generally upon the whole of
the assessable property of the town, or upon the property of
persons to be benefited thereby.

H. The justice of the peace, resident in said town or
hereby declared to be conservators of the peace of said town,
and it shall be their duty to order the arrest of any person
found breaking the peace or disturbing the quiet and order of
said town, or violating any of the ordinances made by Com-
missioners for securing the safety of the property or lives of
the inhabitants of said town, and shall have power to require
any person so offending to give security to keep the peace, or
in default thereof, may commit such person to the county
jail for not more than forty-eight hours, and in addition
thereto may for the commission of said offense impose a fine
on such person of not more than five dollars; and such person
in default of payment thereof may be committed to the county
jail for a period of not more than five days. All fines, penal-
ties and forfeitures under this sub-title of this Article, and
not otherwise provided for shall be recovered before a justice
of the peace for said county resident in said town in the name
of the Commissioners, and applied to the benefit of said town;
and in all such proceedings the bailiff shall have the same
power to proceed in the same manner, and have the same fees
as constables, and for police duties shall be entitled to the
same fees as constables, and all process shall be returnable
before some justice of the peace resident in said town.

I. The said Commissioners may lay an equal tax, not to
exceed thirty- five cents on the one hundred dollars of all
the assessable property within the limits of said town for the
purposes of said corporation, and may authorize the town
bailiff to collect the same ; and the said bailiff shall have the
same power to distrain for said tax as the collectors of county
taxes and levies possess, and to enforce in like manner the
payment thereof by sale; the said taxes, when collected,
shall be by said bailiff paid over to the Town Commissioners,
and in default the bond of said bailiff shall be liable to said
Commissioners, and the said Commissioners in levying the
tax aforesaid shall be governed by the State and county
assessment of all such property .

K. The bailiff and clerk shall each attend the meeting
of said Commissioners, and shall each take and subscribe an
oath to be administered by some one of the Commissioners
for the due and proper discharge of the duties of their
