of the said bonds at not less than the par value thereof, to raise
money to carry into effect the provisions of this Act, as here-
inafter provided for, and all bonds remaining unsold in their
hands shall be cancelled by the Mayor and Councilmen of
Frostburg.

SEC. 3. Be it enacted, That the said Mayor and Councilmen
are hereby authorized and empowered to build and erect a new
reservoir, or to repair and rebuild the old one, as they may think
best, and if they should deem it best to build a new reservoir
they are hereby authorized and empowered to buy or lease
land necessary for said reservoirs or condemn it, according to
an Act of the General Assembly, eighteen hundred and ninety,
Chapter one hundred and thirty.

SEC. 4. Be it enacted, That if any money be left over from
the sale of said bonds after the said new reservoir is built, or
the old one is repaired, and rebuilt as aforesaid, then it may
be spent by the Mayor and Councilmen in obtaining a greater
supply of water.

SEC. 5. Be it enacted, That it shall be the duty of the
Mayor and Councilmen of Frostburg at the next regular elec-
tion for Mayor and Councilmen succeeding the passage of this '
Act, to submit to the qualified voters of said town the ques-
tion as to whether or not the said reservoir shall be built or
repaired as aforesaid under this Act, and at such election the
ballots cast upon said question shall have the words "For
reservoir" or "Against reservoir," as the voters shall desire,
and if a majority of the votes cast upon said question shall be
"For reservoir," then the Mayor and Councilmen of said town
shall proceed without delay to execute the power vested in
them by .the provisions of this Act; but if a majority of the
votes cast upon the question shall be "Against reservoir,"
then the Mayor and Councilmen shall not execute any of the
powers vested in them by this Act, and it shall be the duty of
the said Mayor and Councilmen to give the usual notice of
the time and place of the said election; and the ballots pro-
vided for in this Act shall be deposited in a separate box
specially provided for the same; and at least ten days before
said election is held they shall cause this Act to be published
in some newspaper printed in said town.

law until it is too late to give the notice provided for in the
preceding section, it shall be the duty of the Mayor and
