LAWS OF MARYLAND.

If no election
held, may
appoint
another day.

SEC. 8. And be it enacted, That if anything shall prevent
any election being held on the day appointed, the Commis-
sioners shall appoint another day for holding the same, and
shall within ten days thereafter give notice thereof at least
five days previous thereto, and the Commissioners shall fill
all vacancies in their own body which may happen within the
year.

SEC. 9. And be it enacted, That the said Commissioners
may meet from time to time, as often as occasion shall require,
upon the business of the corporation, and not less than once
in every month; and they shall at their first meeting after an
election choose one of their number as president of the board,
wh6se duty it shall be to preside at all meetings of the Com-
missioners, preserve order and enforce the by-laws, resolutions
and ordinances of the corporation, and the president of the

Commissioners shall by virtue of his office have and exercise
within the limits of the corporation all the jurisdiction and
powers of a justice of the peace, except as to civil cases, and
the acknowledgment of deeds and other instruments of writ-
ing, and the taking of affidavits, and shall receive in all
criminal cases the same fees which are now allowed by law to
a justice of the peace in similar cases; but all such fees shall
be paid into the treasury of the town; and all fines collected
by the President of the Commissioners for the violation of any
by-laws or ordinances of the said town shall be paid into the
treasury of said town.

SEC. 10. And be it enacted, That the President of the Com-
missioners shall be the treasurer of the corporation, and shall
give bond to the Commissioners of Midland, with security to
be approved by them in such penalty as they shall prescribe,
conditioned for the faithful performance of his duty as treas-
urer, and shall receive and pay out moneys according to the
direction of the Board of Commissioners, and shall report to
them at least every three months an account of his receipts
and disbursements; and the said treasurer's bond, when
approved by the Board of Commissioners, shall forthwith be
filed for record in the office of the Clerk for the Circuit Court
for Allegany County, Maryland, and the recorded copy of
said bond shall be legal evidence in any suit or action which
may be brought against said bond in the Circuit Court for
said Allegany County.

SEC. 11. And be it enacted, That it shall not be lawful
for any Commissioner or other officer elected or appointed
under this charter to be engaged or concerned, directly or
