waters of the Choptank river, in said counties, for sale from the
first day of November and the fifteenth day of March next
succeeding, both inclusive, on which last-named day the
license shall expire; provided, that nothing in this section
shall authorize the taking of oysters with scoop, scrape or
dredge above a straight line drawn from the long wharf at
Cambridge, known as Thomas' Wharf, on the Dorchester

shore, to the Bowdle House, on the Talbot shore, immedi-
ately opposite, or in any tributary of said river above or
below said line; and provided further, that the applicant shall
pay such clerk the sum of one dollar and ninety cents per
gross ton, according to the capacity of the vessel to be
licensed, which capacity shall be determined by gross tonnage,
and all boats measuring less than five tons gross shall pay
eight dollars for said license, which shall be good for one
season only, and shall only authorize the catching of oysters
between the first day of November and the fifteenth day of
March next succeeding. In addition to the tonnage fee here-
inbefore provided, said clerk at the time of issuing said
license shall inquire under oath of the applicant how many
men he intends to carry on such boat in any capacity, and
shall receive from said applicant the sum of fifty cents per

provided, that the waters of Talbot County, lying between
Black Walnut Point and a line drawn from the southwest
corner of Second Kent Point to Wade's Point, except the
waters between Poplar Island and the mainland, lying within
a straight line drawn from Paw Paw Point, on Tilghman
Island, to the southwesternmost point of Poplar Island, and
by a straight line drawn from Low's Point on the mainland to
the end of North Point, on Poplar Island, which are reserved
for the taking or catching of oysters with tongs worked
exclusively by hand shall be open to the citizens of Talbot
