directly or indirectly interested in said net, fyke, haul
seine, boat or cther contrivance, and he shall pay before
the delivery of such license to the Clerk of the Circuit
Court for his county or the Clerk of the Common Pleas
of Baltimore city, if he resides therein, the sum
of five dollars for each and every pound net
fyke, haul seine or other contrivance for taking fish that
be five hundred yards and under in length, and three
dollars for each and every additional five hundred yards
or additional part thereof that he may propose to use,
and a fee of twenty-five cents to said clerk for issuing
same, and said clerk shall state upon such license the
number and size of nets proposed to be used by the
licensee.
"95. Any non-resident of this State violating sections
90 to 98, inclusive, of this Article, by the use of any
pound net, fyke net, haul seine, boat or other contriv-
ance now known or hereafter invented, in the tak-
ing or catching of fish shall, on conviction thereof
before some justice of the peace of any county of
the State most accessible, forfeit said pound net, fyke
net, haul seine, boat or other contrivance, now used
or hereafter invented, for taking fish, together with all
boats, vessels, tackle used in the violation of this Act, or
fined a sum of not less than fifty dollars and not' more
than one hundred dollars, or both fine and forfeiture, in
the discretion of the justice of the peace trying the same,
providing the person feeling aggrieved shall have the
right of appeal to the Circuit Court of said county.
"98. The use of pound nets or stake nets shall be abso-
lutely prohibited in the Chesapeake bay, north of a line
one mile south of Pool's Island, except the bay shore of
Kent county up to Howel's Point at the mouth of Sassa-
fras river, and also on the Susquenanna river; and any
person who shall engage in fishing for sale, with the use
of said pound net, stake net or similar contrivance now
used or hereafter invented, shall he subject to the same
fines and penalties as are prescribed in section 95 of this
Article.
"And provided further, that all persons using haul
seines and similar contrivances, except pound nets and
stake nets, which are hereby prohibited, shall pay the
same license and be subject to the provisions of all the
