"Entitled an Sot to regulate the practice of medicine
and to regulate the fees and emoluments thereof; to pre-
vent the practice of medicine and surgery by unauthor-
ized persons, and provide for the punishment of violators
of the provisions of this Act by fine or Imprisonment, or
both, and to repeal and re-enact with amendments sec-
tions 39, 40, 41, 45, 49, 53,58 and 59, of Article 43, of the
Code of Public General Laws, title ‘Health,' sub-title
‘Practitioner of Medicine,' and to add a new section to
said Article, to follow sectIon 39, to be designated as
‘Section 39 A.'
"Section L Be it enacted by the General Assembly of
Maryland, That sections 39, 40, 41,45, 49, 53, 58 and 59,
of Article 43. of the Code of Public General Laws, title
‘Health,' sub-title ‘Practitioners of Medicine,' be and the
same are repealed and re.enacted with amendments, and
that a new section be and the same Is hereby added to
said Article to follow section 39, to be designated as ‘Sec-
tion 39 A,' and to read as to said several sections as fol-
lows:
"From and after the promulgation of this Act, no per-
son excepting those already engaged under existing laws
In the practice of medicine and surgery, shall practice
medicine in any of Its departments within the State of
Maryland, unless the person shall possess all the qualifi-
cations required by this Article.
"39 A: The Governor from nomination of twelve per-
sona nominated by the Medical and Chirurical Faculty of
Maryland, and a similar nomination by the Maryland
State Homeopathic Society shall appoint two boards of
medical examiners consisting of eight persons each, who
shall perform the drties prescribed by this Article of
which respective boards five members shall constitute a
quorum for the purpose of holding examinations and
granting certificates to applicants for the same, and
the Governor shsll have power to remove any
or all of the members of said boards, for Inefficiency or
neglect of duty and to fill vacancies occurring thereon
from any cause whatever from names similarly recom-
mended.
"Section 40. The medical examiners herein provided
for shall consist of two boards, one of physicians and
surgeons recommended by the Medical and Chirurgical
