1900.] OF THE SENATE. 1235 buying or selling oysters in this State, who shall own or have in his possession any instrument of measurement for oysters in the shell which differs in size or description from the measures hereinhefore mentioned, or shall de-- mand a greater measure than hereinhefore mentioned, shall be guilty of a misdemeanor and punished upon con- viction by a court of competent jurisdiction; be fined a sum of not less than $50, nor more than $100, or commit- ted to the House of Correction for a period of not less than three months nor more than six months, or both,. in the discretion of the judge or justice of the peace trying the same; and in case a fine is imposed under the provisions of this section, said fine to be paid. over by the officer making the arrest to the Comptroller of the State, to be credited. to the Oyster Fund; one half, how ever, to be paid to the informer." On motion of Mr. Applegarth, The Senate concurred in the proposed amendment, and The bill, as amended, was passed by yeas and nays as follows: AFFIRMATIVE. Messrs. President, Gray, Applegarth, Kirwan, Baker, Marsh, Betts, Messick. Brewington, Moses, Bryan, Peter, Crothers, Putzel, Dennis, Wilkinson, Dodson, Williams, of Har., —18. NEGATIVE—None. Also returned, Senate bill No. 264, entitled. "An Act to incorporate the Columbia Telephone and Phonograph Company." Endorsed: "Amended, read a third time and passed by yeas and nays." AMENDMENT PROPOSED. At the end of section 4. insert the following: "Provided, further, that before using the public or county roads the assent of such use by the Board of County Commissioners must be first bad and obtained. |
