fairest way of arriving at a proper result of the vote
cast for the contestant and contestee in said county is to
examine the ballots. We therefore suggest the passage
of the following order:

Ordered by the House of Delegates, that James E.
Belt, Clerk of the Circuit Court of Prince George's
county, produce the ballot boxes containing the ballots
cast at the election held in said county on the 7th day of
November last, before the Committee on Elections of the
House of Delegates, at the State House in the city of
Annapolis, on Monday, February 19th, 1900, at 5 P. M.
And it is further ordered, that a certified copy of this
order be forthwith served upon the said James B. Beltv
Clerk of the Circuit Court of Prince George's county, by
the Sergeant at Arms of the House of Delegates.

Mr. Wolfinger, on behalf of the minority of the com-
mittee, submitted the following report, and moved that
it be substituted for the minority report:

To the House of Delegates of Maryland,

As a member of the Committee on Elections of the
House of Delegates, to which was referred the memorial
and papers embodying the contested election case of
Charles W. Darr against George B. Merrick, who was re-
turned elected, and who is now serving in the said
House, I am unable to concur in the opinions expressed
by a majority of said committee, and, therefore, beg
leave to respectfully submit these statements of my con-
clusions in the shape of a minority report.

1 There has not been submitted a sufficient amount of
testimony on the part of the contestant to the committee-
men to establish any fact of any mistakes or fraud on the
part of the election officers.

2. In compliance with section 134, of Election Laws of
of this State, we, as members of this committee on elec-
tions, have no authority to demand the ballot box of the
several precincts of Prince George's county to be brought
before said committee.
