 XXIV.
3473 and 3483 to the said Thomas Beall, of Samuel, or his assigns, in the same manner as if the
agent aforesaid had returned them in the certificate of his sale to said Thomas Beall, of Samuel,
saving to all persons any right or title which they may have acquired to the same, or any part
thereof.

Duration.
An ACT for the destruction of squirrels in Caroline county.
BE IT ENACTED, by the General Assembly of Maryland, That if any person, residing in Caroline
county, shall carry to any justice of the peace of the said county the scalp or scalps of any
squirrel or squirrels, such person shall be allowed, in the levy of the said county; for every squirrel
scalp the sum of three cents; and the justice of the peace before whom such scalp or scalps shall be
brought is hereby required to give the person bringing the same a certificate thereof, and cause the
said scalp or scalps to be burnt, or otherwise destroyed.

    II.  PROVIDED NEVERTHELESS, AND BE IT ENACTED, That no person shall be entitled to any allowance for any such scalp or scalps, without first making oath, or affirmation, as the case may be, or otherwise
satisfy the said justice, that such squirrel or squirrels was or were killed in the said county, and
that no certificate hath been obtained from any other justice of the peace for the same; and that it
shall be the duty of each and every justice of the peace before whom such scalp or scalps shall or may
be brought in virtue of this act, to take and receive the oath, or affirmation, of the person bringing
the same, free and clear from all charge against the person making such oath, or affirmation, any
thing to the contrary hereof in any law notwithstanding.

    III.  This act to continue and be in force till the twentieth day of October, eighteen hundred and
three.

Who are to apply
to a justice,
&c.
An ACT to open a road from Severn ferry, in Anne-Arundel county,
                                       to Patapsco lower ferry.

WHEREAS it is represented to this general assembly, by the petition of sundry inhabitants of
Anne-Arundel county, that they experience great inconvenience for want of a direct road
from Severn ferry to Patapsco lower ferry, and praying a law may pass appointing commissioners to
open a road, at the expence of the county, on the most direct course from Severn ferry to Patapsco
lower ferry; and it appearing that the same would be of great public convenience; therefore,

    II.  BE IT ENACTED, by the General Assembly of Maryland, That Henry H. Dorsey, Horatio Ridout,
George Abshaw, Thomas Lee and Henry Duvall, be and are hereby appointed commissioners
for that purpose, and any three of them are hereby authorised to lay out and open, at the expence
of Anne-Arundel county, a road, not exceeding thirty feet wide, from Severn ferry to Patapsco, in
said county, in the most convenient direction they may think proper; and the said road, when so
laid out and completed, shall be recorded among the records of said county, and be thereafter deemed
and taken to be a public road, and shall be kept in repair as other public roads in said county are
directed to be kept.

    III.  AND BE IT ENACTED, That the commissioners aforesaid shall and they are hereby directed to
apply to any justice of the peace for the county aforesaid, who shall issue his warrant, under hand
and seal, directed to any sheriff of the county aforesaid, commanding him to summon five freeholders,
disinterested as to the lands, and not connected with any person through whose lands the said road
may pass, to appear at a place and on a day by him to be appointed, and after taking the following
oath, or affirmation, as the case may be, to wit: " I A. B. do swear, or solemnly, sincerely and
" truly declare and affirm. that I will honestly and faithfully estimate and value the damage and injury
" sustained by C. D. by opening a road through the land of the said C. D. in pursuance of the directions
" of this act," shall proceed to ascertain and value what damages may be sustained by any
person or persons through whose land the said road may pass by opening and clearing the same, taking
into consideration all conveniencies and inconveniencies, advantages and disadvantages, arising from
opening the said road, and shall return the damages by him assessed to the clerk of the said county,
and the damages so assessed shall be conclusive; and after the valuation so made, the said commissioners
shall proceed to open and clear the same; provided, that the said road shall not pass through any
houses, gardens, orchards or meadows, unless with the consent of the owner thereof.
