inside of her hind feet white about Three yeares old & used with the Cattle of Aron
Bishop & with the Cattle of the plt: & Aron Bishop did goe into the Indian Towne
and there did accompany the Cattle of Rowland Beevins two or three mounths which
Said Cow did Calve in the said Indian Towne but by the Said Shockley deft: the said
Cow Togeather with her Calfe was Drove to the said defts: house the Cowe by the said
deft: mismarked & the Calfe marked in the said defts: marke which said Cowe & Calfe the
plt: did make diligent enquiry After & found her with her Eare Cropt of both sides of her
head Close & was Claimed by the said deft: which Cow is Since dead a coming of her own
Accord to the plts: plantacon Now the plt Sayes he is damnified for want of the said
Cow & Calfe & the losse of her increase to the vallew of Sixteen hundred pounds of =

defendeth the force & injury that although our demurer being cast yet nevertheless
wee Crave benefitt of the Act of Assembly although the Jury Cleard us in August Case
by their verdict being above a yeare if there had been such case of Action where there is
Now being not found guilty of fact then, Now the plt: goes Cuningly & Craftily & brings
In his owne Suite the selfe same bisness and declares amongst the rest after he saith the
mismarking of the said Cow &a: which cow is since dead a comeing of her owne accord to
The plt: plantacon as if the Cow (of his) could Speake meere Nonsence neither doth he =
Mention noe time certains when mismarke nor time when he was a Coming to his plantacon
In regard the issue is joind wee desire that he may prove in the first plance that Cowe as he
Claimeth his & in what nature he forcible kept this Cow otherwise if not his wee most
humbly desire satisfaction for unjust Molestacon
And the plt by his Attourney aforesaid sayes that he ought not to be debarred his accon
aforesaid & this he prayes may be enquired of by the Country & the deft: alsoe
Whereupon Comand was given to the sheriff of this County to cause to come here Twelve good
and lawfull men of his Bayliwick by whome the truth of the Matter might be the better known
which being don Came the said parties by their Attournyes aforesaid & the Jurors: of that
Jury likewise came vizt: Samuell Collins George Collins William Leyton Thomas Holbrook

Henderson Richard Warren Gydian Tillman who being Elected Treyed & Sworne to Say
