mr: Wm: Anderson of Accomack County in Virga: in a plea of debt
And whereupon the plt: by James Sangster his Attourny comes & Sayes that the sd deft
Stands justly indebted unto the plt: in the full & just Sume of One pound four shillings & Ten
pence Sterl. money being the ballance of An Account for a greater Sume & is here in Court
prduced
which said Sume of One pound ffoure shillings & Ten pence sterl: the said deft: did faithfully
promiss & Assume the plt: to Satisfie & pay but the said deft: fraudently & Craftly //
intending to deceive the plt: the Sha Same hath not paid & yet denyed to pay to the plts:

This may certife that This day being the eight day of June 1688 mr: William
Andersen came before me & did declare upon the holly Evangelist that Symon Perkins
Senr: was indebted justly to him upon ball of Accot: the Sume of One pound foure Shillings
and Ten pence Sterl: and that the said Anderson has not reced Any Satisfaction and
That the Said Sume of 1lb. 4S: 10D is still due and was promiss to be paid in ready Mony Sterl
In Testimony whereof I have hereunto Sett my hand dated & vtsupll: Thomas Welburne (?)
And the said Symon Perkins Senr: came & defendeth the force & injury &a: & for his
plea saith That Wm: Anderson aforesaid hath not brought his Action agt: him in due
manner & forme according to an Act of Assembly held at The Citty of St: Marys the 1-
day of August Anno 1681 entitled an Act for preventing Unnecessary & vexatious
Suites at Law Wherein it Sheweth that whereas divers & Sundry persons within this
province contracting debts by Accots: with merchants & others for which thy Stand and
Remaine Only debitor: upon their books of Accots: the wch: tho thy be honnestly & well
disposed to pay the same upon demand first had & required of the said debt by the said Creditor
or other Lawfully Authorized to receive the Same without which it is impossible for the
Said Debitor: to know where or to whome to pay the said Debts yet Severall of the said
Creditors: through a vexatious & Avaritious humor: doe daily Comence their Suites at
