Som^r:set County Ss James Nevill of this County was attached to answ^r: unto Capt^a: W^m:
Whittington of accomack County in virg^a: in an action y^t: he the s^d: James
Nevill Render unto the pte three hundred pounds of tobacco & unjustly?
& unjustly deteineth the Same
And whereupon the plte by his attorney John Taylor Comes & Sayes that in the year
1681 upon the 5^th: day of December the def^t: became indebted unto the plte the full &
Just sume of three hundred pounds of tobacco as by an Instrum^t: of writing from under
the hand of the S^d: Nevill here in Co^rt: produced but Soe the Evidences being dead Canot
Come by the debt in Comon Law whereupon the plt Craves a Jury for to trye the matter
by Comparing his hand written one with Another the plte often demanding the afores^d: three
hundred pounds of tobacco w^ch: he utterly ~~denies~~ refuseing to pay whereby the pl^t: saith
that he is Damnified to the vallue of six hundred pounds of tobacco & there upon brings
his Sute / pro quer John Taylor pledge de pro }Jn^o: Doe
this writing following read Richard Roe
These presents oblidgeth me James Nevill my heires executors adm^rs: to pay or Cause to
be p^d: unto William Whittington his heires or assignes the full & Just sume of three hundred
pounds of Good tobacco & Caske upon demand to be p^d: Coveniently in Northampton County
wittnes my hand this first day of December 1681 James Nevill
