June the 13th: 1689 135
Their Oaths Doe say wee of the Jury doe find for the Deft: Whereupon it is Considered
by this Court here that the said Capt: Henry Smith take Nothing by his said Writt but be
in Mercy for his false Clamour and that John Ellis Senr: goe thereof without day -
And it is further Considered by this Court here that the said John Ellis Senr: recover agt:
The said Capt: Henry Smith the sume of of Tobao: for his Cost & Charges
in this behalfe laid out and expended according to the forme of the statute &t:

And Whereupon the plt: by Edmund Beauchamp his Attourney Comes & Sayth
That in the yeare of our Lord 1686 the said Augustine promissed to pay me
As his Attourney in Two accons vizt: one Comenced by James Inglish agt:
The said Augustine The other on the behalfe of Augustine agt:the sd: Inglish
which the plt: did his utmost indeavors: in & about the premisses the said Augustine
Denyeteh & still doth denye to pay the same being 200lb: of Tobao: the plt: sayth he is
Damnifeyed and hath damage to the vallew of 800lb: of Tobao: & thereupon
brings This Suite
And the deft: in his proper prson Cometh and defendeth the force & injury when &t: & prayes
Liberty to imparle hereunto untill the next County Court & it is granted him the same day
is granted to the plt: alsoe =
At wch: said County Court Vizt: the 13th: day of June in the xiiiith: yeare of the Domion of
the Domion of the Rt: honoble: Charles &t: annog Domi 1689 Came the said prties and the
Said Augustine Sayth that he knoweth nothing in barr or avoidance of the accon aforesd:
Whereupon it is Considered by this Court here that the Said Edward Jones recover agt:
The said Augustine as well the Sume of Two hundred pounds of Tobaccoe Debt as
alsoe the Sume of of Tobo: Cost of Suite & the Deft: in Mercy &t:
