Sommersett County Thomas Manlove late of this County was attached to answ^r: unto ffrancis
Baker in an accon of defamacon &c
And whereupon the plte by Thomas Poole his Attourney Comes & Saies y^t he the said Thomas upon y
third day of August last past in the year of our Lord 1683 at the house of John Goldsmith Sen^r: the
Said Thomas did maliciously defame and abuse the plte & Called him theefe & many other ill
names & violent Blowes to the great hinderance & disadvantage of y plte being in A strange
place And alsoe the said Thomas did openly declare to y people there at the aforesaid house that y
plte did Steale his negroe from his fence Side whereupon the plte Saith he is Damnified and
hath Damadge to y vallue of Sixteene hundred pounds of tobacco In his Creditt & reputacon &
there upon brings this Sute : / Pledge de Pro Jn^o Doe
pro quer Tho: Poole Ric^d: Roe
And the Said Thomas Manlove def^t:Commeth & def^s himselfe & pleades not guilty & this he prayes
may be tryed by the Contry To y w^ch the plte agrees Therefore It is Comanded y^t the Sherife of this County
Cause to Come here Twelve good & Lawfull men to Trye the issue Joined between ffrancis Baker plt
& Thomas Manlove def^t: Evidences Sworne before the Co^rt: & Jury on the part of the plte John Shipway

And the Same day to witt the 14^th day of november Came as well the said ffrancis Baker by his
Attorney Thomas Poole And the said Thomas Manlove In his proper person as the said Jurors to witt

Selbe, Sam^ll: Handy: W^m Walton: Donack Denis W^m Keenes: who to say the Truth being Summoned
Impanelled & Sworne upon theire oathes Say y^t they finde for the plte Two hundred pounds of Tobacco
Therefore this Co^rt: ord^r: That the def^t: Thomas Manlove pay unto the plte ffrancis Baker Two hundred
pounds of Tobacco & Cost of Sute alias execucon ~ ~ ~ ~ ~ ~ ~ ~ ~

Sommersett County Ss: ffrancis Baker late of this County was attached to answ^r unto
Thomas Manlove in an accon of the Case ~ ~ ~ ~
And whereupon the plte by Thomas Poole his attorney Comes & Saieth y^t he the Said ffrancis upon
the Tenth day of November in the year of o^r: 1682 Did agree with y plte to mall 800 Logs from Loggs
upon the plts plantacon by xstmas following w^ch he the Said Baker did faithfully promise to
performe the aforesaid Parcell of Loggs and rec^d full Satisfaccon of the plte for the same but he
the Said Baker Little regarding his promise but fraudulently intending the plte to deceive of y
quantity of foure hundred of the aforesaid Loggs Doth deny & Still doth Deny to pay the Same
although often thereunto required by the plte whereupon y plte Saith he is Damnified & hath
Damadge for want of his Loggs According to bargaine To y value of 600^lb: of tobacco & thereupon
brings this Sute ~ ~ ~ ~ Pledge de pro Jn^o Doe
pr quer Tho: Poole Ric^d Roe
Plaintiffe & def^t Joyne issue & putts themselves to be tryed by the Co^rt the def^t desires the decl^a
may be proved: John Jenkins Susanna his wife & Henry Smith plant^r being summoned appeares
& are Sworne This Co^rt findes wanting by the oathes of y wittnes 420 loggs & therefore orders
y^t ffrancis Baker def^t Compleate & ffurnish four hundred & twenty fence Loggs on the plts
Land forthwith & pay Cost of Sute alias execucon ~ ~ ~ ~ ~ ~ ~ ~
