Whereas by ord^r of Co^rt attachment issued ag^t the goods Chattles & debts of m^r: William Darvile for foure
Thousand four hundred pounds of tobacco to answ^r unto John Winder in an accon of Acc^ot: w^ch writt of attachm^t
was returned by the Sherife the 14^th day of August last past & was attached on the 15^th day of June last past Two
Ships anchors on the plantacon of Capt^a: John Winder belonging to the Said William Darvile & on y
13^th: day of november last at the request of the plte the Co^rt: ordered that William Elgate Sen^r: & Daniell Hast were
appointed appraysers to apprayse the said Anchors they being first Sworn before some one Magistrate of
this County then weight them and make true appraysem^t: to the best of theire Skill & knowledge and give report
thereof To the next County Co^rt: To be holden y second Tuesday in Jan^ry: And this day To witt the 5^th: day of
ffebruary 1683 the said W^m: Elgate & Daniell Hast made a returne in manner & forme following vizt
Memorandum this day the 15^th of December 1683 Whereas by vertue of y above mentioned order wee the
above mentioned W^m: Elgate Sen^r: & Daniell Hast being Sworne before m^r: William Brereton one of his Lopp^s
Justices of the Peace for this County aboves^d in obedience to the above mentioned order have weighed the two
Anchors w^ch: weigh one Thousand forty Six pounds w^ch: wee apprayse & value at one pound of tobacco
pr pound in Confirmacon of w^ch: wee the above mentioned have hereunto Set o^r: hands and Seales the day

Whereupon (this day to Witt the 5^th day of February Annoq Do^m: 1683) This Co^rt: ord^rs: that the Two Anchors
Attached of m^r: William Darvile be delivered by the Sherife to Capt^a: John Winder or his assignes for the
use of Capt^a: John Winder being in part of a debt proved due to him from the Said William Darvile. ~

This day to witt y 5^yj February 1683 banes of matrimoney were published three times betweene Hope Taylor & Margaret
Donicks both of this County no person forbidding the Same ~ ~ ~ ~ ~ ~ ~ ~
This Court adjournes till to Morrow Morning eight of y Clock

ffrancis Baker def^t James Langster of y Same County in a plea y^t he render unto y plte Two pare of
french fall Shoes w^ch: to y plte he oweth & unjustly deteineth ~ ~ ~
And whereupon the plte declares that on the 14^th: day of february last past the def^t became indebted to the plte
the Summe of one hundred pounds of tobacco for Attorneys fees in an accon depending betweene John
Goldsmith plte & the said John Baker def^t now in Consideracon y^t the S^d Baker def^t: Coulld not procure
tobacco to pay the Said fees Did faithfully assume and promise to pay to y S^d plte the abovesaid Two
pare of Shoes March Co^rt: last past notwithstanding of y said assumpcon and promise y def^t fraudulently
and Craftily intending to deceive the plte hath utterly refused the paym^t: of the Said shoes & yet Doth
deny the Same to the plts great Loss & Damadge To y value of Two hundred pounds of tobacco & here upon
brings his Sute pldeges de P^ro Jn^o Doe

These presents Doe witness that I ffrancis Baker of y County of Som^rsett in y Province of Maryland Doe
Constitute & appointe James Langster of y S^d: County & Province my true & Lawfull attorney ag^t: John Goldsmith of
y Same County & province in an accon of Debt Witnes my hand this 14^th day of feb^ry 1682/3

Som^rset County Ss John Christopher late of this County was attached to answ^r unto Andrew
Whittington Inholder in an accon of Debt &c
And whereupon the plte by Thomas Poole his attorney Comes & Saith y^t he the S^d John in the year of
o^r: Lord 1683 became indebted unto y plte the full & Just Sume of four hundred & three pounds of tobacco
as pr acc^ot: here in Co^rt produced w^ch: acc^ot: he the S^d John did assume upon himselfe & faithfully promise
to pay & Satisfie unto y plte but he the S^d John Little regarding his promise or assumpcon but
fraudulently intending the plaintiffe to deceive of the sume aforesaid of four hundred and
three pounds of tobacco Doth denie & Still doth denie to pay the Same although often there unto required
by the plte where upon the plte Saith that he is Damnified & hath Damadge to the value of Six
hundred
