The Same Day Commrs as afore
Whereas by ordr of Cort attachment issued agt the goods Chattles & debts of mr: William Darvile for foure
Thousand four hundred pounds of tobacco to answr unto John Winder in an accon of Accot: wch writt of attachmt
was returned by the Sherife the 14th day of August last past & was attached on the 15th day of June last past Two
Ships anchors on the plantacon of Capta: John Winder belonging to the Said William Darvile & on y
13th: day of november last at the request of the plte the Cort: ordered that William Elgate Senr: & Daniell Hast were
appointed appraysers to apprayse the said Anchors they being first Sworn before some one Magistrate of
this County then weight them and make true appraysemt: to the best of theire Skill & knowledge and give report
thereof To the next County Cort: To be holden y second Tuesday in Janry: And this day To witt the 5th: day of
ffebruary 1683 the said Wm: Elgate & Daniell Hast made a returne in manner & forme following vizt
Memorandum this day the 15th of December 1683 Whereas by vertue of y above mentioned order wee the
above mentioned Wm: Elgate Senr: & Daniell Hast being Sworne before mr: William Brereton one of his Lopps
Justices of the Peace for this County abovesd in obedience to the above mentioned order have weighed the two
Anchors wch: weigh one Thousand forty Six pounds wch: wee apprayse & value at one pound of tobacco
pr pound in Confirmacon of wch: wee the above mentioned have hereunto Set or: hands and Seales the day
and year above written ~ ~ ~ ~ ~ ~ ~ ~ ~ ~ William Elgate (Seale)

Whereupon (this day to Witt the 5th day of February Annoq Dom: 1683) This Cort: ordrs: that the Two Anchors
Attached of mr: William Darvile be delivered by the Sherife to Capta: John Winder or his assignes for the
use of Capta: John Winder being in part of a debt proved due to him from the Said William Darvile. ~

This day to witt y 5yj February 1683 banes of matrimoney were published three times betweene Hope Taylor & Margaret

This Court adjournes till to Morrow Morning eight of y Clock

ffrancis Baker deft James Langster of y Same County in a plea yt he render unto y plte Two pare of
french fall Shoes wch: to y plte he oweth & unjustly deteineth ~ ~ ~
And whereupon the plte declares that on the 14th: day of february last past the deft became indebted to the plte
the Summe of one hundred pounds of tobacco for Attorneys fees in an accon depending betweene John
Goldsmith plte & the said John Baker deft now in Consideracon yt the Sd Baker deft: Coulld not procure
tobacco to pay the Said fees Did faithfully assume and promise to pay to y Sd plte the abovesaid Two
pare of Shoes March Cort: last past notwithstanding of y said assumpcon and promise y deft fraudulently
and Craftily intending to deceive the plte hath utterly refused the paymt: of the Said shoes & yet Doth
deny the Same to the plts great Loss & Damadge To y value of Two hundred pounds of tobacco & here upon
brings his Sute pldeges de Pro Jno Doe

These presents Doe witness that I ffrancis Baker of y County of Somrsett in y Province of Maryland Doe
Constitute & appointe James Langster of y Sd: County & Province my true & Lawfull attorney agt: John Goldsmith of

Whittington Inholder in an accon of Debt &c
And whereupon the plte by Thomas Poole his attorney Comes & Saith yt he the Sd John in the year of
or: Lord 1683 became indebted unto y plte the full & Just Sume of four hundred & three pounds of tobacco
as pr accot: here in Cort produced wch: accot: he the Sd John did assume upon himselfe & faithfully promise
to pay & Satisfie unto y plte but he the Sd John Little regarding his promise or assumpcon but
fraudulently intending the plaintiffe to deceive of the sume aforesaid of four hundred and
three pounds of tobacco Doth denie & Still doth denie to pay the Same although often there unto required
by the plte where upon the plte Saith that he is Damnified & hath Damadge to the value of Six
hundred
