Somm^rsett Ss: Capt^a: Thomas Jones Late of this County was Summoned to answ^r unto William ffurnis
in an accon of assalt & Batry ~ ~ ~ ~ ~ ~ ~ ~ ~ ~ ~ ~
And whereupon y said ffurnis by his attorney Thomas Poole Saith y^t hee y said Jones in this instant
moneth of June & upon y Sixth Day of y moneth aforesaid in y yeare of o^r Lord God 1677: Did upon his
Lopp^s highway against y plantacon of William Turpin in this County make assault & him y said
ffurnis & his wife Did beate wounded & evill intreated that of their lives they Did Despaire & oth^r harmes
hee Did them to y great Damadge of y plaintift & contrary to y pease & governement of y Proprietorey
whereupon y plaintiff Saith y^t hee is Damnified & hath Damadge to y value : Two Thousand nine hun
dred pounds of Tobacco Thereupon brings his Suit: / : ~ ~ ~ prquer: Thomas Poole:
And the said Thomas Jones in his proper person Cometh & Defendeth the force when &c & saith y^t hee y said
William his accon ought not to have by reason y said Thomas hath neither forme nor sense to answ^r unto
Imp^r: Somm^rsett there is noe Such place in this Province : / : ~ ~ ~ ~ ~ ~ ~ ~ ~ ~
# in an accon of an assalt & Batry which is noe English words & itt agrees not with y originall y originall being
assault & Battery ~ ~ ~ ~ ~ ~ ~ ~ ~ ~ ~ ~ ~ ~ ~ ~
# hee ought to have exprest y yeare & Dominion of his Lordship & not by name of Proprietorey: ~ ~ ~ ~
# hee ought to have exprest w^th what weapons y assault was committed & in what manner Acted for tis noe ~~
assault without force & armes: ~ ~ ~ ~ ~ ~ ~ ~ ~ ~ ~ ~ ~ ~ ~ ~
# hee Calls himselfe y plaintift there being noe Such tearme in Law nor is itt an English word: ~ ~ ~ ~ ~
# hee Calls his Lopp^s peace by y name of pease by reason of which nonsense & mistakes y Def^t: sayes that
there is not ground in Law for him to answ^r thereunto the which hee is ready to averr & therefore prayes A
nonsuit with his Cost &Chardges in this Case had & illegally sustained: / : T: Jones: :/:/~ ~ ~
