And Whereupon y said West by his attorney Thomas Poole Saith that hee y said John became indebted
unto him y Said West y full & just Summ of Six hundred & fifty & three pounds of good sound mer
chantable Tobacco & Caske as will more plainely in Cort: appeare by a certaine wrighting under the
hand of him y said John bearing Date y fifteenth Day of September in y yeare of or Lord God 1669
wherein hee Did assume upon himselfe & promise to pay or cause to bee paid unto y Said West his
heirs or assignes y Summ aforesaid of 653lb pounds of tobacco & Caske & hee y said John Did binde
himselfe his heirs executors or assignes to pay as aforesaid but hee y said John Little regarding his
promise & assumpcon fraudulently intending y aforesaid West to Deceive of y Summ aforesaid of
of 653lb pounds of Tobacco although often thereunto required y plaintiffe Saith yt hee is Damnified
& hath Damadge to y value of 1300lb pounds of Tobacco & Caske & thereupon brings his Suit: / : -

This bill bindeth mee John Anderson my heirs executors or assignes to pay or cause to bee paid unto
John West his heirs or assignes y just Summ of five hundred & seaventy three pounds of good ~
sound Tobacco & Casqe Due to bee paid att or upon y tenth Day of november next ensueing y
Date hereof in Pocomoke river & for y true performance hereof I have hereunto sett my hand this
15th: of September 1669) more forty five pounds of Tobacco to bee paid as aforesaid as wittness my
hand y Day & yeare abovesaid more thirty five for a broad axe : John: Anderson: Seale:/

by y Country: Therefore itt is Commanded the Sheriffe of this County to Impannell a Jury to Come
