Somm^rsett Ss: John Aleward Tayler of this County was Sumoned to answ^r unto James Wetherly in a plea of Debt : / :
And whereupon y said James by his attorney Thomas Poole Saith y^t hee y said John became indebted unto him y
Said James in y full & just Summ of Two thousand four hundred & thirty pounds of Tobacco & Casqe as by a certain
writeing under his hand & seale bearing Date y tenth Day of November in y yeare A^o:D^o: 1676 which writeing
here in Co^rt wee have to produce wherein y said promise^s & assume^d upon himselfe & Did binde himselfe his
heirs exec^rs: or adm^rs: to pay or Cause to bee paid unto y aforesaid James his heirs Exec^rs: or adm^rs, or assignes
y aforesaid summ of 2430^lb of Tobacco but hee y s^d John little regarding his promise & assumpcon but fraudulently
intending him y said James to deceive of y summ aforesaid although often thereunto required whereupon y s^d
plaintiffe saith y^t hee is Damnified & hath Damage to y value of 2998^lb pounds of Tobacco and thereupon ~
brings his Suit: / : pr quer: Thom: Poole:/: ~ ~ ~ ~
And y said James by his attorney furth^r saith y^t y writt is returned by the Sherriffe N: est: Invt^r: & therefore
humbly prayes that they may proceede & have y grannt of an attachment: / : ~ ~ ~ ~ ~ ~

This Bill bindeth mee John Aleward in y County of Somm^rsett & province of Maryland Tayler mee my ~
heirs executo^rs administrato^rs & assignes in y just & full summ of Two thousand four hundred & thirty
pounds of good sound merchanteable Tobacco & Casqe to Containe y same & that to be paid unto James ~ ~
Wetherly of y same County & province aforesaid him his heirs or assignes upon Demand as wittness

Due upon y within written bill from John Aleward one thousand nine hundred & thirty pounds of

And thereupon this Co^rt: orders an Attachment on y goods Chattells or Creditts of John Aleward for two
Thousand eight hundred pounds of Tobacco to answ^r y suit of James Wetherly in a plea of Debt
