And Whereupon y Said Randall Revell by his attorney Thomas Poole Saith yt hee the said John Tyler became indeb
ted unto him y Said Randall y just Summ or quantity of one thousand three hundred pounds of Tob: in Casqe ~
good Sound merchantable as pr accot: here in Cort: produced more plainely will appeare but hee y Said John
fraudulently intending him y Sd Randall to Deceive of y Said 1300lb tob: in Casqe Denyeth & Still Doth to
pay y same although often thereunto required y plt: Saith hee is Damnified & hath Damage to y value of

And whereupon y said John by his attorney Thomas Poole Saith yt hee y said Draper Did in y moneth of May last
past Did bargaine with y said Tyler for his Shallop to fetch thirty Cutts of board timber from Pocomoke & for y
which hee y said John paid him y said Draper four hundred twenty seaven pounds of Tobacco & now y Sd Draper
Denyes to performe his bargaine with him y Said Tyler whereupon y plt: Saith hee is Damnified & hath Damage
to y value of one thousand pounds of Tobacco & thereupon brings his Sute prquer: Tho: Poole: / : ~ ~ ~ ~
And y Deft: by his attorney Henry Smith Cometh this Day to witt y 6th Day of ffebry: Ao: Dom: 1676: to Defende
y force & injury & Saith that y Deft: his accon ought not (his accon) the Lawe to bring there being noe Cause of

full & just Summ of seaven hundred forty nine pounds of Tobacco & Casqe as pr acct here in Cort produced more plainely
will appeare but hee y said Arnold fraudulently intending him y said West to Deceive of y aforesaid Summ of 749lb
of Tobacco Denyeth & Still Doth Deny to pay y Same although often thereunto required y plt: Saith hee is Damnified
& hath Damadge to y value of fifteene hundred pounds of tobacco & thereupon brings his suit: pr quer Tho: Poole:/:

Sheweth Whereas yor petitionr was left a servt here in Somrsett County by Capta: Daniell Penfax of London And yor petitionr hath
continued upon y plantation of y Sd: Penfax in Pocomoke river y full terme & time of five yeares according to the
Law of this province now his Said Master not being in y Country not having left any attorney behinde him yor
Petitionr: humbly Craves yt an order may bee grannted him for his ffreedome and yor Petitionr as in Duty bound
