And Whereupon ÿ Said George by his attorney Thomas Poole Saith yt hee y said John & his wife Did in y
moneth of December last past in y yeare Ao:Dom: 1676 maliciously & basely Defame him y aforesaid
George & saith yt hee the said George Did kill or Slay a hogg in y woods & brought itt home without head or
ears whereupon y plt saith hee is Damnified & hath Damadge in his reputation & Creditt to y value of Two
Thousand nine hundred pounds of Tobacco & thereupon brings his suit./: P quer: Tho: Poole:
And the sd John Jenckins Commeth & Defendeth himselfe & saith yt y plt: hath noe Cause of accon & prayes
a nonsuite ~ ~ ~ ~ ~ ~ ~ ~ ~ ~ ~
And Nicholas ffountaine & Grace his wife being Subpa on y part of y plt: appeare before y Cort: & are
Sworne vizt Nicholas ffountaine aged thirty eight yeares or thereabout Sworne Saith that Tymothy
Macknamarra telling him yt John Jenckins would Speake with him went to y said Jenckins & after some
Discourse Shewed mee y quarter of meate which George Trehearne gave him & told mee yt hee went
into y Sd George his house & asked him if hee killed more hoggs y Said George hold him yt hee killed a
wild Shoote y said Jenckins Demanding y eares made him noe answr: & y said John Jenckins tould mee yt
hee thought fitting to Send to Send for mee before hee made use of y sd meate although hee was a poore
man hee would not bee Scandelized, then yor Deponent Desired y Sd: Jenckins to say noe more than
what hee could answr this being y effects of y Discourse concerning y premisses above mentioned betweene
John Jenckins & yor Deponent above mentioned about y 15th Day of December last past furthr saith not:/:

Grace ffountaine aged thirty yeares or thereabout Sworne saith yt John Jenckins Comeing to or house y 12th: of
December last or thereabout I asked him whether George Trehearne was att home & hee told mee hee was just
now gon with gun to looke for hoggs I asked John Jenckins if that was a time of Day for him to goe hog hunting
hee replyed & tould mee hee Doth allwaies goe about yt time of the Day to hunt for hoggs I asked y said ~ ~
Jenckins what Store of hoggs y sd: Trehearne have killed hee said hee Did not knowe but wt hoggs hee have killed
hee brings home in ye night & Dresses them I asked y said Jenckins where y said George had them & hee said
hee had them in mr: Revells neck for hee came with them that way from y Landing & furthr saith not /:

Sommrsett: Ss: John Wooten of this County was sumoned to answr unto George Howell in an accon of assault & battery
Whereupon y sd: George by his attorney Tho: Poole Saith yt upon y first of this present moneth of January
Ao:Do: 1676 hee the said Wooten att y house of Miles Grey in this County mad assault & him y sd George beat
wounded & evill intreated yt of his lifehee Did Dispaire &other harmes to him hee did to y great Damadge of y
plt: & Contrary to y peace & Governement of y Lord proprietary whereupon y plt: saith hee is Damnified &hath ~~

And Alexander Draper Jacob Cheltenham & Thomas Davis of Annamessex hundred being Subpa: on y part of y
plt were Sworne & examined: And this Cort: fines noe Cause of accon on y part of George Howell agt Jno: Wooten
and therefore orders a nonsuite but findes by y wittnesses Cause of accon in y Lord proprietaries Suite agt y
said Jno : Wooten for being druncke and therefore orders yt y sd: John Wooten pay unto y Rt Honr:ble the
Lord proprietary Two Shillings & Six pence or y value thereof & y Sherriffe to receive the same : / :

Whereas Tristram Davis Servant to ffrancis Roberts was brought this Day before y Cort: to have his age ~~
judged itt was made appeare to y Cort: yt hee was bound an apprentice to learne y art of navigation Thomas
Davis master of y Indeavour of Barbadoes The which Thomas Davis sould him for a servant to ffrancis ~~
Roberts to serve y said ffrancis according to y Custome of y province which being contrary to y covenant
betweene y sd Thomas Davis & y Sd:Tristram Davis & whereupon this Corts: opinion is not to proceede to give
judgement of y age of y said Tristram Davis: ~ ~ ~ ~ ~ ~ ~ ~
