SommrSett Ss:Anne Ackworth y relict of Richard Ackworth Deceased Declareth agt Collo:Wm: Colebourne in an accon of y
And whereupon y Said Anne by her attorney Thomas Poole Saith yt hee y Said Colebourne Did receive thirteen
hundred Seaventy three pounds of tobacco which hee pretended hee had bill for but produced none allthough
hee hath been thereunto required which Tobacco hee received of y aforesaid Anne in y yeare of or Lord God
one thousand Six hundred Seaventy three as by a receipt under y hand of him y aforesaid Colebourne here-
produced in Cort: will more plainely appeare y plaintiffe Doubting yt Shee hath paid y aforesaid Summe
of 1373lb of Tob: in her owne wrong requires y bill otherwise order for y tobacco be repayed back to y plt:

And y Said William Colebourne Cometh & Defendeth &c by his attorney Henry Smith & after some Dispute ~

pounds of tobacco & Casqe with Cort: Chardges And that Collo: Wm: Colebourn the then high Sherriffe for this
County Did Serve execution upon y Said Arrundell for y Sd: Debt of yor petrs: but now Soe itt is may itt please
yor Worships yt by neglect of y Said Sherriffe y Said Arundell is gone away into anothr Government & yor petr
not any wise satisfied his Sd: Debt hee therefore humbly prayes an ordr agt y Sd Collo: Wm: Colebourne y then
high Sheriffe for y Sd ffour hundred twenty & four pounds of Tobacco & Caske with Cort: Chardges . / . ~ ~ ~

Humbly Sheweth: That whereas John Kimball contrary to act of assembly brought into this province severall mares geldings
& Colts to y great Damadge & vexacon of his Lopps good people especially in this county of sommrsett yor petitionr know
eing y great injury yt is Sustained by y great multitude of horses & mares made his address to mr Brereton one of
his Lopps Commrs of y County of SommerSett & to him made knowne & Did informe him yt hee he aforesaid Kimball had
brought horses & mares & Colts into this province Contrary to y good lawes of this province which yor petr: humbly
Craveth order in y behalfe of y Lord propry: for y Condemnacon of y horses & mares which is in number ~

And as in Duty bound Shall pray:
And this Day to witt y fifteenth Day of november Annoq Domini 1676: Came y Deft: John Kimball by his
attorney Henry Smith to Defend y force & injury &c & saith yt they have brought neither horses Mares gueldings
nor Colts into this province out of any othr: Government but wt were brought into this County were brought from
y head of y Bay in this province belonging to his Lopps: y Lord: & propry of this province &c:This Cort: commands
y Sherriffe of this County to Impannell A Jury to Come here of Twelve whoe are Sworne vizt Major Ambrose
