Sommersett Ss Thomas Ball was attached to answr unto William Arrundall in an accon of ye Case
And the plte William by his Attorney Tho: Poole Saith that the Said Tho: Ball Did in the year
one thousand Six hundred seaventy & three became indebted unto the Said Arrundall the
Summe of Six hundred & ninety pounds of Tobacco Good marchantable Tobacco & Caske as
pr his Accot will appeare but the Said Thomas Ball fraudulently intending to deceive
him the Said William of the said 690lb of Tobacco although often thereunto required.
The plte Saith he hath Damadge & is Damnified to the value of Two Thousand five hundred
Pounds of Tobacco & thereupon brings his Suite,/, pro quer Tho: Poole

then that there is Seaven hundred & forty pounds of Tobacco due to him:/: ~ ~ ~ ~
The plte by his Attorney Thomas Poole further Saith the Sherife was at ye house of Thomas Ball
and the Said Ball absented himselfe from the Sherife And therefore humbly Craves writt of
Attachment And thereupon this Cort orders that an attachmt: be issued forth upon ye Goods Chattles
& debts of Thomas Ball (to ye value of one Third more then is Sued for) to answr unto William
Arrundell in an accon of the Case;/; ~ ~ ~ ~ ~ ~ ~ ~ ~ ~ ~

said Thomas in ye yeare of or Lord God one Thousand Six hundred seaventy & three ye just summe
or quantity of one hundred Sixty & two pounds of Tobacco as pr accompt here in Cort produced more
plainely will appeare but hee ye said German fraudulently intending to deceive him ye said Thomas
of ye aforesaid 162lb of Tobacco Denieth & Still Doth to pay ye Same although often thereunto required The
plt Saith hee is Damnified & hath Damage to ye value of 1000lb of Tobacco & thereupon brings his Suit &c:
