Sommersett Ss Tymothy Lane of this County was summoned to answer
9 to Randall Revell in A plea of Trespas upon the Case &c
And whereupon the said Randall by his Attourney Henry Smith Saith
That he the said Tymothy became Indebted unto y said Randall the Just
Summe or quantity of Seaven hundred thirty five pounds of tobacco
and Caske as pr accot: here produced in Cort: Doth appeare The said
Tymothy Assuming upon himselfe and promising to pay unto the said
Randall the said quantity of seaven hundred thirty five pounds
of tobacco & Caske & for the true performance thereof the said Tymothy
Did Sett his hand to his Accompt in the said Randalls Booke which
is also ready to be produced here in Cort: but he the said Tymothy
Intrat agt: Janr: fraudulently intending to Deceive him the said Randall not regarding
Cort: 1674 his promise and Assumpcon to make payment Denyeth & Still doth
to pay the said seaven hundred thirty five pounds of tobacco & Caske
although often thereunto required The plt: saith he is Damnified
and hath Losse to y vallue of one Thousand and foure hundred
seaventy pounds of tobacco And Caske Anth thereupon
