And whereupon the said John by his Attourney Thomas Poole
saith that he the said Phillip became Indebted unto him y said
John in the full and Just quantity of Three hundred twenty and
foure pounds of good sound marchantable tobacco and Caske as by
A Certaine writing (here in Cort: produced more plainely will
appeare ) signed with the hand and Sealed with the Seale
of him the Said Phillip bearing Date the third Day of May
Annoq Domini 1669 wherein the said Phillip did Assume
upon himself and promise to pay or Cause to be payd unto the sd:
John the said quantity of 324lb: of tob: and Caske Conveniently
upon Demand in Manoakin after the 10th: Day of November next
ensueing the Date of y said writing And for the performance
thereof bindes himselfe his heires and assignes; But he the
said Phillip fraudulently intending to Deceive him the said
John of the sd: 324lb: tob: & Caske Denyeth and Still Doth to pay the
same Allthough the same hath bin Severall times Demanded
The plt: saith he is Damnified and hath Dammadge to the
vallue of seaven hundred pounds of Like tobacco in Caske
