34 was summoned to answer unto Mathewe -
Stevens in A plea of Trespas upon the Case &c ; /
And whereupon the said Mathewe by his Attourney Edward
Jones saith That they the said John and Morgan became
Joyntly and severally Indebted unto him the said Mathewe
in the full and Just quantity of foure hundred forty
foure pounds of good sound marchantable Tobacco in
Caske being Due to him the said Mathewe for severall goods
and marchandizes That they the said John and Morgan Did
take up of him the said Mathewe (as pr accot: here in Cort: produced
more plainely will appeare ) for the which goods they the said
John and Morgan Did Jointly and severally Assume upon
themselves and promised payment But they the said John
and Morgan Little regarding theire promise and Assumpcon
fraudulently intending to Deceive him the said Mathewe
of the Aforesaid quantity of 444lb: tobacco in Caske Denyeth
and Still Doth to pay the same Allthough often thereunto -
required The plt: saith he is Damnified and hath Dammadge
To the vallue of one Thousand pounds of Like Tobacco in Caske
