The same Day Commrs: as afore
Thomas Jones plt:
pro quer Edwd: Jones in A plea of Debt that he render 1000lb: of tobacco wch: he owes and
vers unjustly deteineth &c.
Jeremiah Hooke deft: The plt: and deft: being Called appeared in Cort:
The plt: Attorney Edward Jones desires their decla: may be read
Sommersett Ss:
Jeremiah Hooke Late of this County was Attached to answer
unto Thomas Jones in A plea that he render one thousand
pounds of tobacco wch: he owes and unjustly deteineth &c.
And whereupon the said Thomas Jones by his Attorney Edward
Jones saith That he the said Jeremiah Hooke by A Certaine
speciallty (wch: is produced by the plaintiffes Attorney here in
Cort: ) Signed with the hand and Sealed with the Seale of him the
said Hooke Did assume upon himselfe and promise to pay or
Cause to be paid to the said Thomas Jones or his order one
Thousand pounds of good Sound marchantable tobacco and Caske
The said tobacco being Long Since Due, but he the said Hooke
Little regarding his promise and Assumption, but fraudulently
intending to Deceive him the said Thomas Jones of the said
tobacco; denieth payment and Still doth allthough often De
manded, The plt: saith by his Attorney Edward Jones
that he is Dampnified and hath Damage to the vallue of Two
thousand pounds of tobacco and thereupon brings his Sute &c.
The specialty read vizt
Know all men by these presents that I Jeremiah Hooke of Somersett
County in the Province of Maryland Carpentr: doe acknowledge to ---
Stand indebted unto Thomas Jones of St: Maries County in the aforesd
province gent: in the full and Just Quantity of one Thousand pounds
of good Sound marchantable tobacco in Caske to be paid in Manoakin
