Edward Jones deft:
Nicholas Huttson plt: and Edward Jones deft: being
Called appeare ~ ~ ~ ~ ~
The plt: desires his Decla: may be read & is vizt
Sommersett Ss Edward Jones late of Sommersett County was
attached to answer unto Nicholas Huttson
in an accon of the Case &c.
And whereupon the said Nicholas Huttson for himselfe
saith that the said Edward Jones Did on the eighteenth day
of January in the XXXiXth: year of the Dominion of the Rt:
honble: Caecilius &c Annoq Domini one thousand six hundred
and seaventy Come into the Tobacco house of him the said
Nicholas Huttson in the County aforesaid; And Did there (in
the absence of the said Nicholas Huttson, unhead looke upon
three hhds: of tobacco and headed them up again approveing
and Likeing the said tobacco, receiving nayling markeing
and weighing the said tobacco being nett one thousand one
hundred thirty one pounds as by A writeing doth more plainely
appeare which is produced by the plaintiffe here in Cort:
The plaintiffe saith That the said tobacco was intended for
mr: Tho: Jones Marchant and produceth here in Cort: that the
Deft: Edward Jones recd: the same for the use of the said mr: Tho:
Jones onely seaventy pounds of the eleven hundred thirty one
being for the plts: rent and his Tax as appeares by the rect:
given to the plt: by the Deft: The plt: saith that the defendt:
Edward Jones as Attorney to Thomas Jones demands the
tobacco
