Sommersett Ss Henry Smith of this County was
Attached to answer unto James Price
in an action of Debt ; / ; ~ ~ ~
Whereupon the said James by William Tompson his Attorny
saith That the said Henry Smith by A Certaine writing
under his hand Did oblidge himselfe to pay to him the said
James the summe of eighteene hundred pounds of Tobacco
at some Convenient place in this County in october last past
alias next fall yett he the said Henry Little regarding but
fraudulently intending him the James of the aforesaid summe
of eighteene hundred pounds of Tobacco to Deceive refuseth
payment by reason of which the plaintiffe saith he is
Damnified to the vallue of Two Thousand nine hundred
pounds of the Like tobacco & thereupon bringeth his Suite ; /
pro quer Wm: Tompson
This Shall oblidge me Henry Smith to pay unto James Price
